. The subject of the contract is – Purchase and delivery of heating diesel oil for the needs of the Police units of the Mazovian garrison.
The order is divided into 7 Tasks:

The grounds for exclusion referred to in Article 108 - concerns tasks 1 to 7
1. The Contractor shall be excluded from the procurement procedure, subject to Article 110 (2) of the Pzp:
1.1 Being a natural person who is legitimately convicted of a crime:
(a) participation in an organised criminal group or a union aimed at committing an offence or tax offence referred to in Article 258 of the Criminal Code;
(b) trafficking in human beings referred to in Article 189a of the Criminal Code;
(c) referred to in Articles 228 — 230a, Article 250a of the Criminal Code, and Articles 46 - 48 of the Act of 25 June 2010 on sports (Journal of Laws of 2020 item 1133 and 2021 item 2054) or Article 54 (1) to 4 of the Act of 12 May 2011 on the refund of medicines, foodstuffs of special purpose nutritional and medical devices (Journal of Laws of 2021 items 523, 1292, 1559 and 2054);
(d) the financing of a terrorist offence referred to in Article 165a of the Criminal Code, or the offence of thwarting or obstructing the determination of the criminal origin of money or concealing its origin in question
in Article 299 of the Criminal Code;
(e) of a terrorist nature referred to in Article 115 (20) of the Criminal Code,
or intended to commit that offence;
(f) entrust the performance of work to a minor foreigner referred to in Article 9 (2) of the Act of 15 June 2012 on the effects of entrusting the performance of work to foreigners residing in defiance of regulations in the territory of the Republic of Poland (Journal of Laws, item 769);
(g) against the economic turnover referred to in Articles 296 to 307 of the Criminal Code, the offence of fraud referred to in Article 286 of the Criminal Code, the offence against the reliability of documents referred to in Articles 270 to 277d of the Criminal Code, or a tax offence;
(h) referred to in Article 9 (1) and (3) or Article 10 of the Act of 15 June 2012 on the effects of entrusting the performance of work to foreigners residing in defiance of regulations in the territory of the Republic of Poland,
— or for an appropriate prohibited act specified in the provisions of foreign law.
1.2 If a sitting member of its management or supervisory body, a partner of the company
in a general or partnership company or a general partner in a limited partnership or a limited joint-stock partnership or a proxy has been convicted of the offence referred to in point 1.1;
1.3 For whom a final court judgment or final administrative decision has been issued
arrears with the payment of taxes, fees or social or health insurance contributions, unless the contractor has paid the taxes, fees or social security contributions due, together with interest or fines, or has concluded a binding agreement on the payment of such debts, as appropriate, before the deadline for the submission of tenders;
1.4 In which the prohibition of applying for public procurement has been ruled legally;
1.5 Where the Contracting Authority may conclude, on the basis of reliable indications, that the contractor has entered into an agreement with other contractors to distort competition,
in particular, if belonging to the same capital group within the meaning of the Act of date
On 16 February 2007 on the protection of competition and consumers, they submitted separate bids,
partial tenders or applications for admission to participate in the proceedings unless they show that they have prepared those tenders or applications independently of each other;

1.6 If, in the cases referred to in Article 85(1) of the PPL, there has been a distortion of competition resulting from the previous involvement of the Contractor or entity that belongs to
with the Contractor to the same capital group within the meaning of the Act of 16 February 2007.
on competition and consumer protection, unless the resulting distortion of competition can be eliminated in a different way than by excluding the Contractor from participation
in the procurement procedure.
2. The Contractor may be excluded by the Contracting Authority at any stage of the procedure
for the award of a contract.
3. The contracting authority shall exclude the contractor against whom the grounds for exclusion referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in connection with Russia's actions destabilizing the situation in Ukraine (Journal of Laws of the European Union, L. of 2014, No. 229, p. 1, as amended), i.e. contractors acting for or with the participation of:
(a) Russian nationals or natural or legal persons, entities or bodies established in Russia;
(b) legal persons, entities or bodies whose ownership rights are directly or indirectly owned by an entity referred to in point (a) of this paragraph for more than 50 percent; or
(c) natural or legal persons, entities or bodies acting on behalf or at the direction of an entity referred to in points (a) or (b) of this paragraph, including subcontractors, suppliers or entities whose capacities are relied on within the meaning of the Public Procurement Directives, where they account for more than 10% of the value of the contract.
The contracting authority shall exclude the contractor against whom the grounds for exclusion referred to in Article 7(1) of the Act of 13 April 2022 on special solutions in the field of counteracting support for aggression against Ukraine and serving the protection of national security (i.e. Journal of Laws of 2023, item 129, as amended) apply, i.e.
a) the contractor and the competition participant included in the lists set out in Regulation 765/2006 and Regulation 269/2014 or entered on the list on the basis of a decision on entry on the list deciding on the application of the measure referred to in Article 1(3) of the Act;
b) the contractor and the competition participant whose beneficial owner within the meaning of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2022, items 593 and 655, as amended) is a person listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a beneficial owner from 24 February 2022, provided that it has been entered on the list on the basis of a decision on inclusion on the list determining the application of the measure referred to in Article 1(3) of the Act;
