1. The subject of the contract is the sale of electricity to the facilities of the Silesian University of Technology with a total estimated volume of 5750 MWh with delivery in the period from 01.01.2024 to 30.06.2024. The average annual energy volume is estimated at 11009 MWh.

1. The subject of the contract is the sale of electricity to the facilities of the Silesian University of Technology with a total estimated volume of 5750 MWh with delivery in the period from 01.01.2024 to 30.06.2024. The average annual energy volume is estimated at 11009 MWh.
2. The contracting authority shall not impose requirements on the structure of fuels used to generate the electricity covered by the contract.
3. It is stipulated that the Ordering Party has the right not to use the estimated amount of electricity – in particular in the following cases: cessation of use of the facility (or suspension of the use of technological equipment installed in the facility), takeover of the facility by another entity, inaccuracies in the forecast of energy consumption in a given facility – and will not incur additional costs in this respect. The settlement will take place for the energy actually consumed, based on the amount of this energy and unit rates specified in the contract.
4. No other fees (in particular commercial fees, subscription fees, expressed in PLN/month) are provided for other than the settlement for the energy actually consumed.
5. The sale of energy shall take place under the conditions specified in the provisions of the Act of 10 April 1997. Energy Law (i.e. Journal of Laws of 2012, item 1059, as amended), in accordance with the implementing regulations to the aforementioned Act, the provisions of the Civil Code, the rules set out in the concession and the provisions of the contract.
6. Information on the means of electronic communication by which the Contracting Authority will communicate with the Contractors and information on technical and organizational requirements for preparing, sending and receiving electronic correspondence
(a) Communication in the procurement procedure, including the submission of tenders, the exchange of information and the transfer of documents or statements between the Contractor and the Contractor, shall be carried out by means of electronic communication, through the Tender Platform of Silesian University of Technology: https://polsl.logintrade.net/rejestracja/ and email: IA1@polsl.pl. The Contractor's use of the Tender Platform is free of charge.
b) An encrypted HTTPS protocol is used to connect. Data encryption is carried out using SSL. The SSL certificate ensures the confidentiality of data transmitted over the Internet. The Contractor with an account on the Tender Platform has access to the possibility of submitting and withdrawing the offer, as well as functionality to ask questions to SWZ content and communicate with the Ordering Party
in the remaining areas.
(c) The technical and organizational requirements for sending and receiving electronic documents, electronic copies of documents and statements and information provided using them are described in the “Instructions” tab of the Tender Platform.
d) The maximum size of files transmitted via the Tender Platform is 150 MB.
e) Time is saved in YYY-MM-DD HH:MM:SS format. The time of transfer of data to the Tender Platform is the time during which the submission of an offer, notice, document or statement by the Contractor will be confirmed.
(f) The Contractor may also provide the above notice, document or statement (not applicable to the offer) to the e-mail address of the Contracting Authority. The Contractor shall, by providing the above notice, document or statement, request confirmation of the delivery of the message. The date of transmission of the notification, document or declaration shall be the date of receipt of the confirmation of delivery of the message containing the above file/ attachments from the Ordering Party's mail server. The maximum size of files transmitted via the Ordering Party's email is 10 MB.
