Description:
The transport of children with disabilities residing in Warsaw in the Wola District with the provision of care during the school year 2022/2023 - procedure number: 16/ZP/22

1) The subject of the contract awarded is the transport of children with disabilities residing in Warsaw in the Wola District with the provision of care during the school year 2022/2023, i.e. from 01.09.2022 until 31.08.2023.

The transfer will be carried out on the route from houses to schools/educational institutions located in Warsaw and back, to schools/centres located outside Warsaw, according to the calendar of the school year 2022/2023 and to the facilities where classes are held within the framework of action “Winter/Summer in the City” during winter holidays and holidays.

2) A detailed description of the subject matter of the contract, the terms and conditions and manner of provision of services constituting the subject of the contract are included in the contract model which is Annex 5 to the SWZ, along with Annex 2 to the contract model and the price form, which is Annex 1 to the SWZ

Object range of the order:

1) The routes of carriage of children are listed in order no. 2 (List of Children and Schools) to the model contract, which is no. 5 to the SWZ.

The list shows carriage routes for 74 children. The Ordering Party allows the possibility of increasing the number of children to a maximum of 85 children. The contractor calculating the offer price must take into account the maximum number of children who may be covered by the order, i.e. 85 children.

2) Persons exercising childcare at the time of the service (Carers) must have preparation for the exercise of basic care and care activities and a completed course or training in the provision of first aid, and at least 3 months of experience care for people with disabilities.

3) The Contractor should carry out services by cars appropriately adapted to the transport of persons with disabilities, in accordance with the requirements of the Contracting Authority specified in Chapter VII of the SWZ.

4) In case of temporary impossibility to provide freight services due to road collision or vehicle failure, the Contractor shall be obliged to substitute a replacement vehicle of equivalent standard within 60 minutes from the occurrence of the event. Note: (a) the response time, i.e. the time during which the Contractor will base the replacement car to the scene, in the event of a vehicle failure or a road collision during the transport of children, shall be the second criterion for evaluating the offer, see Chapter XIV SWZ, (b) number of cars with air conditioning which they will transported children is the third criterion for evaluating tenders, see Chapter XIV of the SWZ.

5) The Contracting Authority requires the Contractor to familiarize himself with the obligations imposed on him by the Act of 11 January 2018 on electromobility and alternative fuels (Journal of Laws of 2021, item 110).

6) The Contracting Authority shall apply a social clause under Article 95 of the Pzp Act in the present proceedings. The Contracting Authority requires that persons carrying out the object and performing the activities of drivers and guardians to be employed by the Contractor or Subcontractor, on the basis of the employment relationship, in accordance with the Act of 26 June 1974 the Labor Code (i.e. Journal of Laws of 2020 item 1320 as amended). Detailed requirements concerning the documentation and verification of the employment of those persons and the power of the Contracting Authority to control that employment and sanctions for failure to comply with those requirements are included in the contract model, constituting No. 5 to the SWZ.

7) Information on the breakdown of the contract into parts - justification, see Chapter II, point 3 of the SWZ.

8) According to the content of § 7 (2) of the model contract, the Contractor is obliged to hold an OC policy for the activities carried out for the sum of insurance not less than PLN 400.000,00, for the entire duration of the contract.

9) The Contracting Authority informs that it intends to allocate the gross amount of PLN 1.513,242,00 to finance the contract.

10) The Contracting Authority does not provide for the possibility of awarding contracts pursuant to Article 214 (1) point 7 of the Pzp Act.

11) Subcontractors: any information relating to subcontracting, the Contracting Authority has included in the model contract, annex 5 to the SWZ. The Contracting Authority requires that the Contractor in the Statement - JEDZ indicate to the Contracting Authority whether the order will perform by its own forces or intends to entrust the Subcontractors with the execution of part of the order.
