Description:
Successive fuel supply for Municipal Department of Communication Sp. z o.o. in Chojnice

1. The subject of the contract is the successive supply of liquid fuels along with transport in the total estimated quantity:

1) Diesel oil — 4,000,000 liters (4,000 m3);

2) Unleaded petrol Pb-95 — 1,400,000 liters (1,400 m3);

3) Unleaded petrol Pb-98 — 130,000 liters (130 m3);

The subject of the contract is the successive supply of fuels together with transport in the quantities indicated in point II.1.4 i.e. 'Short description'

4. Requirements of the Ordering Authority for the object of the order

1) Fuel must meet the quality requirements of the currently applicable Polish Standards:

(a) PN-EN 590+A1:2017-06/Ap1 - for diesel;

(b) PN-EN 228+A 1:2017 -06/Ap1 — for unleaded petrol Pb95 and Pb98

or equivalent to the abovementioned standards

2) Fuels, i.e. both diesel and unleaded petrol Pb95 and Pb98 must meet the quality requirements laid down in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680, as amended)

3. During the course of the contract, the Contractor shall be obliged to attach the current quality certificate of the fuel manufacturer made by the accredited laboratory concerning the batch delivered. Atest must:

(a) contain data characterizing the supplied fuels,

(b) be provided on the date of execution of the test,

(c) be made no earlier than 7 days before delivery.

4) The Contracting Authority requires that the diesel supplied by the Contractor is suitable for the season and the prevailing temperature conditions.

5. Technical and chemical parameters must not be inferior to those specified in the standards and in the Annexes to the Regulation.

6) The Contracting Authority requires the fuel to be transported in accordance with the requirements of the specific provisions on the transport of hazardous materials as set out in the ADR Agreement

7. “In accordance with applicable law, in the event of a discrepancy between the standard and the regulation, the provisions of the Regulation shall apply.”

8) The Contracting Authority shall require the Contractor to declare the fuel manufacturer to ensure the availability of fuel supply to the Contractor and to comply with the quality requirements of the fuel offered by the Contractor for the purposes of the implementation of this invitation to tender.

9) The Contracting Authority informs that the fuel stations and storage tanks to which the Contractor will deliver fuel supply meet all requirements laid down in the Regulation of the Minister of Economy of 21 November 2005 on the technical conditions to which the fuel bases and stations should correspond liquid,

far-reaching transmission pipelines for the transport of petroleum and petroleum products and their location (Journal of Laws 2014 item 1853 t.j. as late as amended).

10) The Contracting Authority shall require the Contractor to include the Contracting Service Station with an existing quality control system of each type of fuel, on the basis of participation in a quality monitoring programme conducted by the fuel manufacturer or subsidiary of the fuel manufacturer, or

individual quality control system, run by the Contractor and at his expense, using an independent laboratory on the basis of a contract/agreement concluded between the Contractor and the laboratory.

(a) The Contractor shall submit to the Contracting Authority, together with the offer, the relevant documents proving the functioning of the fuel quality control system, e.g. certificate, copy of the contract/agreement, laboratory declaration, etc.

(b) The Contracting Authority shall require that the fuel quality test be carried out at least three times per year for each type of fuel supplied. Consequently, the Contracting Authority will not incur any additional costs.
