PROVISION OF ROUND-THE-CLOCK PROTECTION OF PERSONS AND PROPERTY IN A SHIFT SYSTEM IMPLEMENTED BY SPECIALIZED ARMED PROTECTIVE FORMATIONS (SUFO) in the years 2022-2025
I DESCRIPTION OF THE SUBJECT OF THE CONTRACT
1.The subject of the contract is the provision of direct, permanent physical protection with firearms of objects – military complexes.
2. The subject of the contract is divided into five tasks:
Task No. 1:
Profession of direct, permanent physical protection with firearms of objects - military complexes 33. Transport Aviation Base in Powidz
(KW 925, 6015 - airport, 6015-Babin, 936, 4204, 5444, 8748 - Kleczew)
witkowska 8 street, consisting of:
- round-the-clock protection of persons and property located within the boundaries of protected areas and facilities carried out by uniformed, qualified physical protection employees of the Specialized Armed Protective Formation in a shift system;
- round-the-clock protection of people and property on access roads managed by the army
- organization of the security service based on the system of posts, patrols, supervision over alarm systems, operation of pass offices;
Protection of facilities will be carried out around the clock on working and public holidays.
The detailed description of the subject of the contract is contained in Annex 2A to the SWZ, which will be forwarded together with the invitation to tender.
Task No. 2:
Provision of direct, permanent physical protection with firearms of objects - military complex in Ruchocinek (KW 4577) consisting of:
- round-the-clock protection of persons and property located within the boundaries of protected areas and facilities carried out by uniformed, qualified physical protection employees of the Specialized Armed Protective Formation in a shift system;
- organization of the security service based on the system of posts, patrols, supervision over alarm systems;
Protection of facilities will be carried out around the clock on working and public holidays.
The detailed description of the subject of the contract is contained in Annex 2B to the SWZ, which will be forwarded together with the invitation to tender.
Task No. 3:
Provision of the service of protection of persons and property, round-the-clock supervision consisting in receiving signals by radio by the Monitoring Center and undertaking intervention activities by the Rapid Response Intervention Groups of the facilities of the Military Recruitment Center in Konin at 1 Hurtowa Street, consisting in at:
- protection of persons and property carried out by uniformed, qualified physical security employees of the Specialized Armed Protective Formation (SUFO) as part of the concierge service provided:
- taking action by The Rapid Reaction Intervention Groups within 10 minutes after receiving the alarm from the Monitoring Centre;
- round-the-clock supervision (monitoring) of the facility consisting in receiving signals by radio through the Monitoring Center, securing the facility by the intervention partol and monitoring signals, on working days, Saturdays, Sundays and holidays.
A detailed description of the subject of the contract is contained in Annex 2C to the SWZ which will be forwarded together with the invitation to submit tenders.
Task No. 4:
Profession of the service of protection of persons and property, round-the-clock supervision consisting in receiving signals by radio by the Monitoring Center and undertaking intervention activities by the Rapid Reaction Intervention Groups of the facilities of the Military Recruitment Center in Kalisz at St. Joseph's Square 5, consisting in at:
- protection of persons and property carried out by uniformed, qualified physical security employees of the Specialized Armed Protective Formation (SUFO) as part of the concierge service provided;
- intervention by rapid response intervention groups within 10 minutes after receiving an alarm from the Monitoring Centre;
- round-the-clock supervision (monitoring) of the facility consisting in receiving radio signals by the Monitoring Center, securing the facility by the intervention partol and monitoring signals, on working days and non-working days of the institution;

Task No. 5:
Provision of property protection service, consisting in round-the-clock supervision of
and receiving signals from alarm devices by the Monitoring Center, control ramps and intervention activities by the Patrol Intervention /SUFO/ facility in Konin at 1 Kolska Street. Protection of the complex will be carried out in a round-the-clock system consisting of:
- round-the-clock supervision and reception of signals from alarm devices by the Monitoring Center;
- control ramps to the facility along with pedestrian rounds around the building;
- taking action in the event of receiving an alarm signal from the facility by the Intervention Patrol (SUFO) composed of a minimum of 2 (two) security personnel, armed with firearms;

The contractor allows the possibility of submitting requests to participate in the procedure for any number of tasks, taking into account the division of the scope of the contract into 5 tasks.
3. The Ordering Party reserves the right to make changes to the place of performance of protective tasks within the location of the Ordering Party / Recipient in the event of reorganization of the protection system of the organizational unit.
4. The Ordering Party requires that the execution, possession and maintenance of all documentation be in accordance with:
the Instruction on the Protection of Military Facilities – file no. Gen. 1686/2017,

5. Classification of the subject of the contract according to the Common Procurement Vocabulary CPV code: 79710000-4 – Security services
II REQUIREMENTS FOR THE CONTRACTOR REGARDING THE SUBJECT OF THE CONTRACT
1. Contractors who act in accordance with the provisions of the Act on the Protection of Classified Information of 5 August 2010 (T. Journal of Laws of 2019, item 742)., in the Act of 22 August 1997 on the Protection of Persons and Property (Consolidated Text: Journal of Laws of 2021, item 1995, as amended), Instruction on the Protection of Military Objects, ref. Gen. 1686/2017 (for inspection at the registered office of the Ordering Party or the Recipient after prior arrangement of the date with the Plenipotentiary for the Protection of Classified Information of the Ordering Party or the Recipient and other legal acts. Interested persons must present a personal security clearance with a min. RESTRICTED – except for task 5).
2. The Contractor accepts civil liability for culpable damage caused to the property of the Ordering Party / Recipient or to third parties, by persons employed to perform the provisions of the contract, arising in connection with the performance of these duties.
3. The Contractor undertakes to involve the security forces (security commander, security personnel) in training with the pretense of violating the security system of the facilities, ongoing training of security personnel and their shooting of weapons equipped with them, at least once a quarter.
4. The contracting authority requires uniform uniforms of the Contractor's security staff.
5. The Contractor must technically secure its weapon on its own, but for tasks No. 1 and 2 in the room provided by the Ordering Party;
6. Contractors must have an organized security division, a security representative and their own law firm together with the head of the office in accordance with the Act on the Protection of Classified Information of August 5, 2010 (except for task No. 5).
7. The Contractor must have an accredited, autonomous computer station for the production of classified documents, with a min. RESERVED (except for task No. 5).
8. The Contractor must secure on its own a radio communication system ensuring communication between security commanders and posts, working
in land mobile radio communication of the dispatcher type in accordance with the Act of 16 July 2004 "Telecommunications Law" and its implementing regulations.
9. The Contractor's employees intended for the performance of the contract must have personal security clearances authorizing access to classified information with a minimum CLAUSE RESTRICTED or authorization to access this information (except for task No. 5) for security staff at posts, porters and for security commanders together with a current certificate of completion of security training classified information in accordance with the Act on the Protection of Classified Information of 5 August 2010 (T. jedn. Journal of Laws of 2019, item 742) and the ID card of a qualified physical protection employee for guards, security commanders and other persons performing protective tasks.
10. In the case of replacement of an employee, the Contractor is obliged to ensure that the newly engaged employee has at least the same qualifications and permissions. Any changes of employees at security positions will be immediately documented by the Contractor in writing with the attachment of a photocopy of documents confirming the rights and permits confirmed for compliance with the original.
III PROVISIONS REGARDING THE EMPLOYMENT OF PERSONS UNDER A CONTRACT OF EMPLOYMENT:
1. Pursuant to Article 95(1) of the PPL Act, the Contracting Authority requires the Contractor or Subcontractor to employ persons performing the following scopes of activities:
direct physical protection of persons and property performed by qualified security personnel (including security commanders), at fixed or mobile posts, (task No. 1, 2)
operation of the pass office, (task No. 1)
porters, (task No. 1, 3, 4)
direct physical protection of persons and property performed by qualified security personnel (task No. 5)
with the exception of:
persons holding the functions of the head of the secret office and the representative for the protection of classified information,
employees of the Intervention Group, provided that they are engaged outside SUFO employees (only for tasks 3 -5). In the remaining tasks (1 and 2), the Intervention Group will be separated from the persons included in the SUFO shift service.
if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 – Labour Code (Consolidated Text: Journal of Laws of 2022, item 1510, consolidated text).
2. After selecting the offer as the most advantageous and before signing the contract, the Contractor will be obliged to provide the Ordering Party with a personal list of persons provided for the provision of the service and copies of the following documents confirmed by it for compliance with the original:
current personal security clearance authorizing access to classified information with a minimum clause RESTRICTED or authorization to access this information for security personnel at posts, porters and for security commanders, (for tasks No. 1, 2, 3, 4,);
current certificate of training in the protection of classified information in accordance with the Act on the Protection of Classified Information of 5 August 2010 (for tasks No. 1, 2, 3, 4);
the identity card of a qualified physical protection worker (tasks 1, 2, 3, 4 and 5, except for the security officer, the head of the law firm);
the identity card of a person admitted to possess a weapon (tasks 1, 2, 3, 4 and 5,
with the exception of the security officer, the head of the office);
3. In order to verify the employment, by the Contractor or Subcontractor, on the basis of the employment relationship of persons listed in the List, the Ordering Party shall be introduced to request:
1) a statement of the employed employee,
2) a statement of the contractor or subcontractor on the employment of the employee on the basis of an employment contract,
3) certified for compliance with the original copy of the employment contract of the employed employee,
4) certified for compliance with the original copy of documents confirming the employees' application to social security, i.e. ZUS ZUA printouts,
with access only data: from block II – number | NIP and REGON and abbreviated name of the Contractor; from block III – name and surname of the Employee; from block V – only the first two digits of the insurance title code; from block VII – the date of incurrence of the insurance obligation and from block XIV – the date of filling in the form;
5) other documents – containing information, including personal data, necessary to verify employment on the basis of the employment relationship, in particular the name and surname of the employed employee, the date of conclusion of the employment contract, the type of employment contract and the scope of duties of the employee.
4. The employment referred to in paragraph 1 will last for the entire period of performance of the subject of the contract, however, in the event of a change in the composition of the personnel performing the subject of the contract on the basis of an employment relationship, the Contractor shall provide the Ordering Party immediately within no more than 3 days from the date of the change with an updated "List of employees performing the service".
5. Failure by the Contractor to submit the documents referred to in paragraph 3 shall be treated as a failure to comply with the obligation to employ employees on the basis of an employment relationship, resulting in the calculation of a contractual penalty.
IV LOCAL VISION
The contractor can make a local inspection of the complex in which the service will be performed before developing the offer. The Contracting Authority will enable a local inspection to be carried out for interested Contractors after prior written notification of the willingness of the Contractors' representatives to participate in this project to the following e-mail address: 33bltr.przetargi@ron.mil.pl. The application in question should contain the name and surname of the person participating in the on-site visit, as well as a contact number in order to provide details of the time and place of its conduct, which will depend on the number of volunteers. The vision will take place in the presence of authorized functional persons on behalf of the Ordering Party. Persons referred to participate in the meeting by the Contractors must turn out to be a personal security clearance authorizing access to classified information with the CLAUSE RESTRICTED or higher, the legitimacy of a qualified physical security employee (applies to tasks 1, 2, 3, 4, ) and a photocopy of the concession of the Ministry of Interior and Administration allowing the Contractor to conduct business activity in the field of protection of persons and property (applies to all tasks) confirmed for compliance.
V FINAL PROVISIONS
The Ordering Party does not foresee:
a) to conclude a framework agreement,
b) to conduct an electronic auction,
c) reimbursement of costs of participation in the proceedings,
d) settlements in foreign currencies,
e) granting advances for the performance of the contract by the Contractor,
f) submission of tenders in the form of electronic catalogues
g) submission of variants.
