4.1 Subject of the contract and place of performance: 1.1. The subject of the contract is the supply of fuel – diesel oil, depending on the ambient temperature (period) respectively: 1.1.1. summer, 1.1.2. transitional, 1.1.3. winter, 1.1.3.1. whose method of delivery and quality will meet the requirements set out in the currently applicable regulations, in particular in the Act of 25 August 2006 on the fuel quality monitoring and control system (i.e. Journal of Laws of 2021, item 133, as amended) and in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws, item 1680, as amended) and meeting the requirements of the Polish standard PN-EN 590 + A1: 2017-06 / Ap2. 1.2. Total basic order volume: 1370m3 ON, determined under real temperature conditions. 1.3. The Ordering Party reserves the right to purchase fuel in quantities different from the given values, while maintaining the option, depending on the actual needs of MPK, WODMIEJSKIE, STBS, BIOSTAR and PEC. 1.4. Right of option: The Ordering Party provides for the possibility of exercising the option right consisting in increasing the basic scope of the contract, i.e. the quantity of diesel oil delivery under the contract. The largest possible scope of the order taking into account the right of option is 1920m3 ON. The selected Contractor shall be obliged to enable the Contracting Authority to purchase additional quantities of fuel on the same terms as the supplies covered by the basic contract. 1.5. Right of option: The Ordering Party provides for the possibility of exercising the right of option consisting in reducing the quantity of the basic contract to 20% in the event of unforeseen circumstances, and in exceptional cases of force majeure, such as epidemics, pandemics, wars, reducing the amount of diesel oil purchased to 50%.

The right of option is a right of the Ordering Party which may or may not be exercised in the performance of this contract. If the Ordering Party does not exercise the right of option, the Contractor is not entitled to any claim for damages in this respect. 1.7. If the option right is exercised, changes to the contract or conclusion of a separate agreement will not be required. The Ordering Party shall submit an appropriate statement on this occasion.
