1. Supply of electricity for the needs of units of the Poznań Poviat, the Hospital in Puszczykowo and the Institute in Skrzynky, including:
a) Poznań County – 32 collection points in the Poznań Poviat and the city of Poznań; the estimated amount of energy supplied during the term of the contract will be: 2 300 MWh, including energy settled:
• in G tariffs:
a) G11: 286,4 MWh
b) G12: 317,6
– daily: 190.6 MWh
– night: 127.0 MWh
• in other tariffs:
– C11: 379,1 MWh
– C21: 871,4 MWh
– B21: 414,0 MWh
b) Hospital in Puszczykowo – 1 collection point; the estimated amount of energy supplied during the term of the contract in the B23 tariff will be: 2 610 MWh, including:
- morning peak - 539.8 MWh
- afternoon peak - 441.8 MWh
- other hours - 1 628,4 MWh
c) Institute in Boxes – 1 collection point; the estimated amount of energy supplied during the term of the contract, in the C21 tariff will be: 320 MWh

1. The subject of the contract is the supply of electricity for the needs of the units of the Poznań Poviat, the Hospital in Puszczykowo and the Institute in Skrzynky, including:
a) Poznań County – 32 collection points in the Poznań Poviat and the city of Poznań; the estimated amount of energy supplied during the term of the contract will be: 2 300 MWh, including energy settled:
• in G tariffs:
a) G11: 286,4 MWh
(b) G12: 317,6 MWh, including in the zone:
– daily: 190.6 MWh
– night: 127.0 MWh
• in other tariffs:
– C11: 379,1 MWh
– C21: 871,4 MWh
– B21: 414,0 MWh
b) Hospital in Puszczykowo – 1 collection point; the estimated amount of energy supplied during the term of the agreement in the B23 tariff will be: 2 610 MWh, including in the zone:
- morning peak - 539.8 MWh
- afternoon peak - 441.8 MWh
- other hours - 1 628,4 MWh
c) Institute in Boxes – 1 collection point; estimated amount of energy supplied during the term of the contract, in the C21 tariff will be: 320 MWh
2. total energy ordered: 5 230 MWh. The order will be executed successively, in connection with current needs, up to the amount that the Ordering Party intends to allocate for the implementation of the contract, i.e.:
a) Poznań County – 32 collection points – PLN 2,300,000.00 gross,
b) Hospital in Puszczykowo – 1 collection point – PLN 2,600,000.00 gross,
c) Institute in Boxes – 1 collection point – PLN 320,000.00 gross.
3. the proceedings are conducted jointly by the Poznań District, the Prof. S.T. Dąbrowski Hospital in Puszczykowo S.A. and the Institute in Skrzynky, on the basis of an agreement concluded pursuant to Article 38(2) of the Act of 11 September 2019. Public procurement law (Journal of Laws of 2022, item 1710, as amended),
4. the forecast of energy consumption indicated above and in the Description of the subject of the contract is only an approximate value, which may change during the performance of the contract. The actual energy consumption (less or greater than the forecast indicated in the Annexes) will depend solely on the actual needs of the Ordering Party, and the Seller is obliged in each case to apply the energy prices offered in the tender, except for changes provided for in the draft provisions of the contract – Appendix No. 4 to the SWZ
5. the Contractor selected in the proceedings, the Ordering Party shall make the PPE data available in electronic form, immediately after the conclusion of the contract,
6. The Contractor should determine the value of the subject of the contract, taking into account in the price of tariffs the costs calculated in accordance with the legal acts referred to in point 9 paragraph a) of the SWZ and service costs,
7. the contract for the supply of electricity specifies the payer and the addressee of the VAT invoice for the supply of electricity for individual collection points – in accordance with the Descriptions of the subject of the contract attached to the SWZ.
8. The Ordering Party informs that:
a) has separate distribution agreements for all collection points, with the local DSO, i.e. ENEA Operator sp. z o.o., concluded for an indefinite period,
b) the current seller of electricity is Enea S.A., the contract is concluded for a definite period of time with a validity period until 31.08.2023,
c) does not have contracts concluded as part of loyalty or promotional campaigns.
9. The Ordering Party shall require that:
a) The Contractor delivered electricity on the terms set out in the Act of 10 April 1997. Energy Law (Journal of Laws of 2022, item 1385, as amended), the Civil Code and executive acts issued on their basis.
b) electricity, met technical standards in accordance with the provisions of the Energy Law and implementing regulations to this Act and Polish Standards.
c) The Selected Contractor, at the latest on the day of signing the contract, submitted to the Ordering Party a statement on the possession of a valid General Distribution Agreement for the provision of electricity distribution services between the local distribution system operator and the electricity seller, in order to implement the electricity sales contract.
d) The Contractor paid a deposit in the amount of PLN 120,000.00.
