• The amounts of fuels specified above have been calculated taking into account the forecasted consumption and therefore should be treated only as estimates and as such may not constitute the basis for the Contractor to make any claims as to the amount of fuel actually purchased, during the performance of the contract, by the Ordering Party. The Ordering Party reserves the right to increase or decrease, without informing and obtaining the consent of the Contractor, during the term of the contract the estimated demand for fuels without changing the offered discount to unit prices.
• The quality of fuels supplied must correspond to all legal standards in Poland in this regard.
• The quality of fuels supplied must guarantee the free start and operation of vehicles of machinery and equipment of the Ordering Party in all atmospheric conditions occurring in Poland.
• The Contractor will suffer all legal and financial consequences resulting from a proven supply of fuel of improper quality causing, for example, damage to injection systems, particularly new diesel units operating in the Common Rail system, or immobilization of vehicles and all losses of the Ordering Party resulting from immobilization or damage to the components of the vehicle.
• The Contractor shall, at any time, submit a certificate of quality of the supplied fuel for inspection at the service station and/or at the request of the Contracting Authority, submit a written copy w/in the document to the Ordering Party's documentation.
• In the event that the Contractor's Regulations regarding the conditions for issuing and using fuel cards are not contrary to the provisions of the Terms of Reference, including the contract and the Public Procurement Law, and at the same time will be public regulations, the Ordering Party will accept such regulations.
2. Technical conditions of delivery.
• Diesel fuel collection ON - in petrol stations in the city of Szczecinek open 24 hours a day adapted to handle trucks. The collection will consist in successive (depending on the needs) refueling of the Ordering Party's vehicles. Downloading ON intended for equipment will be carried out by refueling to canisters (barrels).
• Form of settlement.
Purchase of diesel fuel ON- non-cash, bulk invoice for the settlement period, payment by transfer according to the contract model.
• Collection of unleaded petrol Pb 95 - at a service station in the town of Szczecinek open 24 hours a day suitable for truck service. The download will consist of successive (needs-dependent) refueling of the Ordering Party's vehicles. The collection of gasoline intended for equipment will be carried out by refueling into canisters.
• Form of settlement.
Unleaded petrol Pb 95 - non-cash bulk invoice for the settlement period, payment by transfer (according to the contract model).
3. The Contracting Authority shall not permit the possibility of submission of partial tenders. Reasons for not splitting the order into parts
-the lack of division into parts does not affect competition, it can even be assumed that it leads to increased competition,
-the lack of division into parts is dictated by economic considerations. The price of liquid fuels has recently shown an upward trend, which means that the division of the order into parts could be associated with an increase in prices for the purchase of liquid fuels. In addition, the Ordering Party requires the performance of the service in a continuous period, and the division of the contract into parts could cause technical difficulties in the implementation of the service and, consequently, downtime. It is reasonable to conclude that the division of this contract into lots would entail excessive technical difficulties and excessive blackbirds.
