1. The subject of the contract is the selection of a contractor who will provide the contracting authority with services consisting in providing all-day nutrition for patients of the Dr Tytus Chałubiński District Hospital in Zakopane, i.e. preparation, delivery of all-day meals (so-called catering) and their distribution to the patient's bed, in accordance with applicable law. The Ordering Party stipulates that the organization of the catering service should also take into account the nutrition of children up to 1.5 years of age. 2. The Contractor's task is to ensure comprehensive all-day (7 days a week, including holidays and non-working days) nutrition of the Ordering Party's patients (including drinks with meals) in an annual average amount (amounts calculated in an estimated manner on the basis of the average number of patients of the Hospital per year): 1) Approx. 43,950 person-days of nutrition of adults, including 950 person-days of nutrition of isolated patients, 2) Up to 20 children up to 1.5 years of age. 3. Detailed requirements of the contracting authority regarding the manner of providing services being the subject of the contract are included in the Description of the Subject of the Contract, [hereinafter referred to as "OPZ"], which constitutes Annex 8 to the SWZ. Other terms of the contract are regulated by the provisions of the Draft Agreement, [hereinafter referred to as "PU"], which constitutes Annex 7 to the SWZ.

The Ordering Party stipulates that the organization of the catering service should also take into account the nutrition of children up to 1.5 years of age. For patients of the Hospital Emergency Department, the Department of Anaesthesiology and Intensive Care and patients with infectious diseases (e.g. in the Covid Ward), meals should be delivered in disposable packaging (both solid meals as well as soups and drinks) along with disposable cutlery. Meals for isolated patients are delivered to the entrance to the ward. 2. The Contractor's task is to ensure comprehensive all-day (7 days a week, including holidays and non-working days) nutrition of the Ordering Party's patients (including drinks with meals) in an annual average amount (amounts calculated in an estimated manner on the basis of the average number of patients of the Hospital per year): 1) Approx. 43,950 person-days of nutrition of adults, including 950 person-days of nutrition of isolated patients, 2) Up to 20 children up to 1.5 years of age. 3. The Contracting Authority stipulates that during the performance of the contract, the Contractor is obliged to have a permit from the locally competent Sanitary and Epidemiological Inspector to conduct activities in the field of collective catering in closed establishments, extended by the delivery of meals to the Ordering Party, the so-called catering. In addition, the Contracting Authority reserves that the Contractor is obliged to have at least two means of transport allowed by the locally competent Sanitary and Epidemiological Inspector to perform the service covered by this contract, in accordance with applicable law. In addition, during the performance of the contract, the Contractor is obliged to submit to the Ordering Party the results of the last inspections of the kitchen and means of transport. 4. Detailed requirements of the contracting authority regarding the manner of providing services being the subject of the contract are included in the Description of the Subject of the Contract, [hereinafter referred to as "OPZ"], which constitutes Annex 8 to the SWZ. Other terms of the contract are regulated by the provisions of the Draft Agreement, [hereinafter referred to as "PU"], which constitutes Annex 7 to the SWZ. 5. The Contracting Authority informs that the present procedure will be conducted according to the so-called "Reverse procedure", in accordance with the provisions of Article 139 of the Public Procurement Law. As part of this procedure, the contracting authority will first examine and evaluate the bids, and then make a subjective selection of the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
