Successive supplies of naped oil

Successive supply of diesel fuel (grade) B, D, F) multi-season (meeting the requirements of the applicable standard: (PN-EN 590+A1:2017-06) in the amount of up to 700,000 l (say: seven hundred thousand liters), with the minimum amount of diesel oil delivered to the Ordering Party being 350,000 l (three hundred and fifty thousand liters), in the period from January 1, 2024 to December 31, 2024 according to the common procurement dictionary No. 09134220-5 to the Company Miejskie Przedsiębiorstwo Komunikacyjne sp. z o. o. in Inowrocław (Contracting Authority). Monthly deliveries of diesel oil to the Ordering Party's service stations will amount to 58,000 litres (say: fifty-eight thousand litres). The average size of a single delivery delivered to the Ordering Party's warehouse will be up to 20,000 litres (in words: twenty thousand litres), and the minimum single delivery delivered to the Ordering Party's service stations will be not less than 16,000 litres (in words: sixteen thousand litres).

2. Deliveries will be made, depending on the needs, to the petrol station of the Company Miejskie Przedsiębiorstwo Komunikacyjne sp. z o. o. in Inowrocław, located in Inowrocław at 33 Ks. P. Wawrzyniaka Street, from 7.00 a.m. to 2.00 p.m within 24 hours after you place the order. The Ordering Party reserves the right to refuse to accept delivery from a partial order outside the hours specified in the preceding sentence. Deliveries will be made on working days, i.e. from Monday to Friday, excluding public holidays within the meaning of Article 1(1) of the Act of 18 January 1951 on non-working days (i.e. of 2 November 2021, Journal of Laws of 2020, item 1920). The Ordering Party will place orders from 7.00 a.m. to 2.00 p.m

3. The Contractor shall provide a diesel quality certificate issued by the accredited laboratory at each delivery.

4. Autocysters equipped with analog flow meters must be sealed (autocysters equipped with electronic flow meters do not need to be sealed.) The sealing of the loading and unloading box in which the infusion and drain valves are placed will be sufficient to comply with the requirement.

5. Receipt (acceptance) of delivery according to the terms and conditions laid down in the contract shall be carried out by authorised representatives of the Contracting Authority and the Contractor, who shall draw up a delivery protocol according to the model of the contract. The Contracting Authority reserves the possibility of taking a sample of diesel fuel from each delivery before the diesel is poured into the Contracting Authority's tanks for the purpose of analysing the supplied fuel in an independent accredited laboratory with the authority to carry out such analyses. The fuel samples will be collected and stored in accordance with the Regulation of the Minister of Economy of 1 September 2009 on the sampling of liquid fuels and liquid biofuels (i.e., Journal of Laws 2014, item 1035) and the Polish standard PN-EN ISO 3170.

6. The basis for issuing a VAT invoice will be the quantities of diesel oil in accordance with the delivery protocol, and the fuel measurement will be carried out using a legalized VEEDER-ROOT device type 846361-314 installed in the Ordering Party's tanks, marked with numbers 2 and 4. The quantity will not be compensated up to the reference temperature of 15º C. In the event of the mandatory introduction of a general obligation to compensate the volume up to the temperature of 15ºC, the Contracting Authority will comply with this obligation by operation of law, and the Contracting Authority and the Contractor shall introduce appropriate changes to the contract in this respect.

7. The Contracting Authority does not provide for the submission of partial and variant tenders.
