The subject of the contract is the conclusion of framework agreements with a maximum of 5 (five) Contractors specifying the conditions and principles on which the Contracting Authority will award unit contracts during its term and the terms and conditions under which the Contractor so selected will provide to the Contracting Authority rail transport services in domestic transport of goods from item NHM-2701, i.e. hard coal from the places of dispatch / loading (direction(s) of transport listed in Appendix 2 to the Agreement (referred to as "Goods Loading Places") to Enea Ciepło sp. z o.o. in Białystok, Branch of Elektrociepłownia Białystok.

The Framework Agreements will be concluded for a period of 36 months (the expected planned term of the Framework Agreement from 01.11.2023 to 31.10.2026 or 36 months from the date of conclusion of the Framework Agreement if it is concluded after 01.11.2023).

The Ordering Party provides that under the Framework Agreement, during its term the quantity of Goods to be transported that may be ordered on the basis of unit Orders granted by the Ordering Party during its term may reach a maximum of 30,000 tons (in words: thirty thousand tons) and this quantity will be hereinafter referred to as the "Maximum Quantity of Goods" from individual Goods Loading Points to the delivery and acceptance point of Enea Ciepło sp. z o.o.'s own siding. Branch of Elektrociepłownia Białystok, Ordering Party's destination station - Białystok Fabryczny.

The Contracting Authority provides for the conclusion of a Framework Agreement with a maximum of 5 Contractors (the Contracting Authority shall conclude with each of the selected Contractors an Agreement with the same content consistent with the template specified in Part 2 of the SWZ.

The subject of the contract will be carried out by the Contractors with whom the Framework Agreement will be concluded.
