The municipality of Waalre wants to work in partnership with the contractor and expects the contractor to proactively contribute to increasing the quality of the public space.

A contract in the form of an agreement is concluded. The agreement is entered into with one contractor. The contract consists of concrete permanent activities for the daily management and maintenance of the outdoor space. In addition, the contract has the precondition that changes and additions can be made during the execution of the contract, so that ambitions and future developments can be realized. The contract becomes a hybrid contract between these two facets of the work:

- an integral maintenance agreement based on a demand specification

- a management team agreement based on the working method of a construction team already known in construction works

These are grouped together in an overarching agreement.

The work to be carried out is within the municipal boundaries of the municipality of Waalre and falls solely under its responsibility. The work is carried out throughout the municipality.

A separate agreement could be concluded for each type of work. This could result in an agreement being concluded with different contractors. However, the municipality wants one contractor contract so that it has a single point of contact for the integral management, as is the case now. As a result, municipal policy can be implemented effectively and simply. With that, the assignment has been merged.

If the assignment is split by, for example, a plot layout, more coordination is necessary. This entails extra activities and therefore more (internal) costs. If the coordination is not optimal, this can lead to delays and therefore additional inconvenience for stakeholders (e.g. residents). In addition, the municipality will be responsible for the planning and coordination of the implementation. Because all this is not in the interest of the municipality, the municipality chooses to have the work carried out by one contractor, with or without the use of subcontractors.
