1. The subject of the contract is the supply of software under the "Microsoft Products and Services Agreement" volume licensing program and expert support or equivalent products for State Administration Units, specified in Appendix No. 1 to SWZ. The Contracting Authority provides for the conclusion of a framework agreement.
2. The subject of the contract shall consist of the following categories of products and services:
1) licenses (sublicenses)
2) license updates
3) subskrypcje
4) expert support of the Manufacturer
5) consultative support of the Contractor
3. A detailed description of the subject of the contract and the manner of its implementation has been specified respectively in the Description of the subject of the contract - Appendix No. 2 to the SWZ, in Appendix No. 3 to the SWZ - The Proposed provisions of the framework agreement and in Annex No. 4 to the SWZ - The proposed provisions of the executive agreement.

4. The Ordering Party requires that the subject of the contract be provided by the Contractor, who has the following rights to sell the products offered:
1) has the manufacturer's authorization to sell the manufacturer's license and provide services under the "Microsoft Products and Services Agreement" volume licensing programs.
(2) where equivalent to supplementary licences is offered, it shall be authorised by the manufacturer to sell the equivalent solution.
5. The Ordering Party informs that as part of the subject of the contract, it intends to purchase government and academic licenses from the MPSA program.
6. whenever in the content of the SWZ the subject of the contract has been described by indicating trademarks, patents or origin, source or special process, the Ordering Party shall allow the Contractor to offer an equivalent solution.
