1. The subject of the contract is the purchase of diesel fuel (B7) (meeting pn-EN590 standards) and unleaded gasoline 95 (E5) (meeting PN-EN228 standards) using electronic fuel cards, for vehicle tanks belonging to the Municipal Headquarters of the State Fire Service in Wrocław.
2. The subject of the contract shall include the delivery of:
a. Diesel fuel (B7) in the forecast volume – 152 000 liters
b. Lead-free ethyline 95 (E5) in the forecast quantity – 4000 liters

2. The subject of the contract is the purchase of diesel fuel (B7) (meeting pn-EN590 standards) and unleaded gasoline 95 (E5) (meeting PN-EN228 standards) using electronic fuel cards, for vehicle tanks belonging to the Municipal Headquarters of the State Fire Service in Wrocław.
3. The subject of the contract includes the delivery of:
a. Diesel fuel (B7) in the forecast volume – 152 000 liters
b. Lead-free ethyline 95 (E5) in the forecast quantity – 4000 liters
4. During the term of the contract, the forecasted quantities of fuel purchase may change, over which the Ordering Party has no influence and it results from the unpredictable number of interventions of rescue and firefighting services. The Contractor shall not make any claims against the Ordering Party
for failure to sell fuels in the amount specified in point 3 while maintaining the minimum value of the order specified in Annex 4 – draft contract § 1 section 5.
5. The offered diesel oil must meet the requirements of PN-EN 590+A1:2017-06, while ethyline Pb 95 PN-EN 228+A1:2017-06.
6. The fuels offered by the Contractor must meet the conditions for admission to trading and use in the Republic of Poland.
7. Any names (trademarks), standards, assessments and technical specifications provided by the Ordering Party in the description of the subject of the contract are of an exemplary nature, and their indication is aimed at determining the expected standard, whereby the Ordering Party allows the submission of equivalent offers pursuant to Article 101(4), (5), (6) of the Public Procurement Law in conjunction with Article 99 of the Public Procurement Law If specific standards are indicated in the documentation of the procedure, assessments and technical specifications, the Ordering Party informs that it allows the use of equivalent solutions described by these standards. A Contractor who refers to equivalent solutions described by the Ordering Party is obliged to demonstrate in the offer - in particular by means of evidence in question - that the supplies, services or works offered by him meet the requirements specified by the Ordering Party.
8. Trademarks, patents or origin, sources or specific processes indicated in the documentation, which characterize the origin of materials, devices, services - serve as auxiliary, it is allowed to use materials, devices and other "equivalent" products provided that technical parameters equal to or better than those obtained through implementation according to the indications of the technical documentation and provided that their use does not result in the need to redesign solutions contained in the technical documentation. A Contractor who refers to solutions "equivalent" to those described by the Ordering Party is obliged to demonstrate that the products and devices offered by him meet the requirements specified by the Ordering Party. In this case, the tender must be accompanied by a description of the proposed product, device, including in addition its technical parameters and the name of the manufacturer.
9. The Ordering Party shall not request the means of proof in question in these proceedings.
