The subject of the contract is the successive delivery of medicinal products for the needs of the District Health Center Sp. z o.o. in restructuring in Otwock. A detailed description of the subject of the contract is included in Annex 1A to the SWZ. The proceedings were divided into 58 parts (tasks).
The Contracting Authority does not provide for the submission of the said means of evidence by the Contractors.

Deliverable no. 1 – Medicinal products1. The exact scope of the subject of the contract is described in Annex 1A to the SWZ, i.e. the assortment and price form.

4. The offered assortment must have appropriate: attestations or certificates or attestations or certificates allowing for use in hospital treatment. The delivered subject of the order should be provided with a commercial label drawn up in Polish, containing the necessary information needed for safe use for the direct user - details of point II.1. 4 SWZ.
5. Supplied medicinal products should be registered in the Republic of Poland or imported in the mode of targeted import with relevant documents, i.e. temporary admission of the Ministry of Health of the Republic of Poland to marketing in the Republic of Poland.
6. The Contracting Authority reserves the right not to use the full quantitative limit of the subject of the contract, without the right to claim in this respect against the Ordering Party, to which the Contractor agrees. The maximum scope of deliveries that may be excluded shall be set by the Ordering Party at 15%, i.e. the minimum guaranteed value of the cash consideration for the performance of the contract is 85% of the value referred to in §3 section 1 of the contract as part of a given task. Details can be found in the model contract (Annex 6 to SWZ).
7. The Ordering Party has the right to submit complaints regarding the quantity and quality of the subject of delivery by means of a written / electronic form. The Contractor shall supplement the quantities and exchange the goods for full-value goods within 48 hours from the date of receipt of the complaint.
8. Deadline for the contract: deliveries will take place successively from the date of conclusion of the contract for 12 months. Deliveries in accordance with the current demand of the Ordering Party with the implementation of up to 2 working days from the date of placing the order.

Task No. 8 – Paediatric electrolyte fluid1. The exact scope of the subject of the contract is described in Annex 1A to the SWZ, i.e. the assortment and price form.
2. The Contractor may offer only medicinal products that are authorized for marketing on the territory of the Republic of Poland and must have current registration certificates, in accordance with the Act of 06.09.2001 Pharmaceutical Law (i.e. Journal of Laws of 2021, item 974).
3. If the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Public Procurement Law, it should be assumed that such references are accompanied by the words "or equivalent", which means that the Contracting Authority allows solutions equivalent to those described, and proper names are used only to specify quality requirements, technical and technological aspects of the Ordering Party - details of point II.1.3 SWZ.
4. The offered assortment must have appropriate: attestations or certificates or attestations or certificates allowing for use in hospital treatment. The delivered subject of the order should be provided with a commercial label drawn up in Polish, containing the necessary information needed for safe use for the direct user - details of point II.1. 4 SWZ.
5. Supplied medicinal products should be registered in the Republic of Poland or imported in the mode of targeted import with relevant documents, i.e. temporary admission of the Ministry of Health of the Republic of Poland to marketing in the Republic of Poland.
6. The Contracting Authority reserves the right not to use the full quantitative limit of the subject of the contract, without the right to claim in this respect against the Ordering Party, to which the Contractor agrees. The maximum scope of deliveries that may be excluded shall be set by the Ordering Party at 15%, i.e. the minimum guaranteed value of the cash consideration for the performance of the contract is 85% of the value referred to in §3 section 1 of the contract as part of a given task. Details can be found in the model contract (Annex 6 to SWZ).
7. The Ordering Party has the right to submit complaints regarding the quantity and quality of the subject of delivery by means of a written / electronic form. The Contractor shall supplement the quantities and exchange the goods for full-value goods within 48 hours from the date of receipt of the complaint.
8. Deadline for the contract: deliveries will take place successively from the date of conclusion of the contract for 12 months. Deliveries in accordance with the current demand of the Ordering Party with the implementation of up to 2 working days from the date of placing the order.
