The subject of this contract is the purchase of electricity for the Employer's facilities and organizational units indicated in the Annex No. 1 to the Terms of Reference.

Puchaczów commune and members of the Purchasing Group as well as their units listed in the Annex No. 1 to the ToR will conclude separate contracts resulting from these proceedings for the award of a public contract in an open tender.

Detailed information on the conclusion of contracts by individual Municipalities and their organizational units is contained in Annex No. 1 and 4.1 to the ToR. The obligation of the selected Contractor will be to terminate the existing contracts for the sale of electricity and provision of distribution services (comprehensive contracts) and to represent the Ordering Party and its organizational units before the relevant distribution system operator in matters related to the conclusion of new distribution contracts. To perform the above actions, the Contractor will receive a relevant power of attorney (Annex 4.1 to the ToR).

The subject of this contract is the purchase of electricity for the Employer's facilities and organizational units indicated in the Annex No. 1 to the Terms of Reference, in accordance with the provisions of the Energy Law of 10.4.1997.

1) Gmina Puchaczów and members of the Purchasing Group as well as their units listed in the Annex No. 1 to the Terms of Reference will conclude separate contracts arising from these proceedings for the award of a public contract in an open tender for "Purchase of electricity for the needs of the Purchasing Group of the Puchaczów Commune". Detailed information on the conclusion of contracts by individual Municipalities and their organizational units is contained in Annex No. 1 and 4.1 to the ToR. The obligation of the selected Contractor will be to terminate the existing contracts for the sale of electricity and provision of distribution services (comprehensive contracts) and to represent the Ordering Party and its organizational units before the relevant distribution system operator in matters related to the conclusion of new distribution contracts. To perform the above actions, the Contractor will receive a relevant power of attorney (Annex 4.1 to the ToR).

Order - purchase of electricity for the facilities listed in the App. No. 1 to the ToR:

1) Estimated electricity demand in the period from 1/1/2020 to 31/12/2020 is 6 685 810.00 kWh.

2) The estimated value of the contract in the period from 1.1.2020 to 31.12.2020 is PLN 2,473,749.70.

3) Performing activities resulting from the power of attorney constituting the Annex No. 1 to the draft contract (Annex No. 4.1 to the Terms of Reference), in particular, the Employer obliges the Contractor to notify the indicated distribution system operator to implement the electricity sales contract concluded with the Contractor, make declarations of will and determine on behalf of the Employer all necessary information in terms of uttering so far the current contract for the sale of electricity and provision of distribution services (comprehensive contract), representing the Purchaser before the relevant distribution system operator in matters related to the conclusion of the contract for the provision of distribution services.

The Awarding Entity acts on its own behalf and on the basis of a signed agreement (agreement available for inspection at the Awarding Entity's seat), on behalf of the following Municipalities as well as their organizational units, which are indicated in Annex No. 1 to the ToR:

- Lubenia commune,

- Milejów commune,

- Trawniki commune,

- Wólka commune.

The ordering party informs that the process of changing the seller takes place for most of the collection points once again. Detailed information on the dates of current electricity sales contracts in the event of another change of seller and the periods of notice of comprehensive contracts in the event of the first change of seller are included in Annex 1 to the ToR. In the Annex 1 to the ToR, the current electricity seller and information on currently concluded price agreements are indicated. Contracts for the distribution of electricity in the case of points with another change of seller are concluded for an indefinite period. Detailed information is included in Annex No. 1 to the Terms of Reference. The Employer provides for the possibility of changing tariff groups from current to new, which are indicated in Annex No. 1 to the Terms of Reference.
