1. The object of the contract is the purchase of gas fuel by the Contracting Authority and their organizational units with a total estimated volume of 27 098,5 (+/- 15%) during the supply period, i.e. from 01.01.2022 to 31.12.2022.
2. The Contractor shall make all the actions and arrangements with the DSO necessary to carry out the procedure to change the seller and to effectively start the sale of gaseous fuel, including in particular: notification to the DSO of new comprehensive gas fuel sales contracts. These actions shall be carried out by the Contractor on the basis of the relevant powers of attorney granted by each of the Contracting Authority listed in Annex No 1 to the SWZ, together with the conclusion of comprehensive contracts for the sale of gaseous fuel.
Gas supplies will be carried out after the conclusion of comprehensive contracts, but not earlier than 01.01.2022 and not earlier than after the positive change procedure of the seller, until 31.12.2022.

The Contractor shall make all the actions and arrangements with the DSO necessary to carry out the procedure to change the seller and to effectively start the sale of gaseous fuel, including in particular: notification to the DSO of new comprehensive gas fuel sales contracts. These actions shall be carried out by the Contractor on the basis of the relevant powers of attorney granted by each of the Contracting Authority listed in Annex No 1 to the SWZ, together with the conclusion of comprehensive contracts for the sale of gaseous fuel.
3.Delivery of gaseous fuel will be carried out on the basis of comprehensive contracts concluded separately by individual Contracting Authority and their organisational units, which will be separate payers, and which are detailed in Annex No 2 to SWZ
4. The supply of gas fuel will be carried out under the terms laid down by the Energy Law Act of 10 April 1997 (Journal of Laws of 2021, item 716 as amended) and on the basis of the implementing provisions of that Act, in particular the Regulation of the Minister of Economy of 2 July 2010 on the detailed conditions for the operation of the gas system (Journal of Laws 2018 item 1158, as amended) Regulation of the Minister of Energy of 15 March 2018 on detailed rules for the formation and calculation of tariffs and settlements in the marketing of gaseous fuels (Journal of Laws of 2018, item 640, as amended), according to the tariff for gaseous fuel of the DSO, the rules laid down in the concessions, in accordance with the terms of the contract, as well as in accordance with the offer of the Contractor and in accordance with the provisions of the Civil Code.
5. The summary of all Contractors, Payers and (PPE) participating in the tender process together with data on historical gas fuel consumption, current distribution parameters and current status of contracts is given in the aggregate statement in Annex 2 to SWZ (Excel sheet ).
6. Data on the quantity of gas fuel purchased are estimated to be calculated on the basis of existing gas consumption. The gas fuel consumption forecast indicated by the SWZ represents only an approximate value which may increase or decrease during the execution of the contract. Notwithstanding the volume of consumption, the Contractor shall, in any case, apply the gaseous fuel prices offered in the tender. The Contractor shall not pursue any financial claims if, during the term of the contract, the Contracting Authority purchases a smaller or greater quantity of gaseous fuel from the Contractor than the forecast.
7. Any new PPE arising in the course of the Agreement must have a unit price provided for for gaseous fuel in accordance with the Contractor's offer selected in this tender procedure. The supply of gaseous fuel for a new PPG not annexed to the contract will be made on the basis of an amendment of the Annex for the contract concerned, without renegotiating the terms of the Agreement.
8. Gas fuel supplied must meet technical standards in accordance with the provisions of the Energy Law Act, implementing acts and Polish Standards.
9. The Contractor shall be obliged to comply with the quality standards of service to the recipients.
10. The Contractor shall be obliged to accept notifications and complaints from the Contracting Authority, at the agreed time, concerning the supplied gas fuel.
11. The Contractor should have no later than the date of the start of delivery a secure access portal for customers to retrieve invoice images and watch gas fuel consumption. The platform should allow individual accounts to be set up for Recipients using the same NIP No. Use of the platform should be free to the Recipient.
