Description:
Aggregate supply – Forest District Milicz, Brzezie Forestry

1) The subject of the contract are successive deliveries of crushed aggregate with continuous grain size as part of the investment task entitled: "Execution of passing tracks on the fire run-off. No 25 in the area of the Forest District Milicz.

2) The item of the order includes the purchase and successive delivery to the place of incorporation (location of the investment task) of the following materials:

a) Broken aggregate with a continuous grain size of 0/63 mm in the amount of 1 700 tonnes,

b) Crushed aggregate with a continuous grain size of 0/31.5 mm in the amount of 820 tons,

c) Fine stone fraction 0/5 mm in the amount of 50 tons,

3) The moisture content of the broken aggregate indicated above at the time of delivery may not exceed 12%.

4) The minimum number of daily deliveries is 300 tonnes. Deliveries will be made from Monday to Friday from 07:00 to 16:00

5) The aggregate indicated above must meet the requirements set out in the Technical Specification constituting Annex 2 to the SWZ.

1) The subject of the contract includes the purchase and successive deliveries to the place of incorporation (location of the investment task) of the following materials:

a) Broken aggregate with a continuous grain size of 0/63 mm in the amount of 1 700 tonnes,

b) Crushed aggregate with a continuous grain size of 0/31.5 mm in the amount of 820 tons,

c) Fine stone fraction 0/5 mm in the amount of 50 tons,

2) In all places of the SWZ and annexes to the SWZ where an exemplary trademark, patent, origin, source or specific process is used, or if the Ordering Party has described the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Public Procurement Law, and in any case, acting in accordance with Article 99(6) and Article 101(4) of the Public Procurement Law, the Contracting Authority shall allow solutions equivalent to those specified in the SWZ and in the annexes to the SWZ, marking such indications or references with the words "or equivalent" or "or equivalent" respectively (m.in the use of materials), provided that parameters are provided not worse than those specified in the description of the subject of the contract. An equivalent solution shall also be admissible where the word 'equivalent' or 'equivalent' is not included in the description of the subject-matter of the contract.

3) The forest road leading from the public road to the place of implementation of the investment task provides the possibility of entering a tractor unit with a semi-trailer.

4) Each batch of delivered aggregate should have documents required by law, conditioning the admission of each batch of delivered aggregate to the market, including in particular: attestations, declarations of conformity, national certificates / European technical assessments, quality certificates, test protocols.

5) When carrying out deliveries of the procedure in question, the Ordering Party reserves the right according to which:

a) The quantities of aggregates included in the scope of the subject of the contract indicated in point 3.1 point 3) of the SWZ are estimates. The amount of aggregate ordered during the performance of the subject of the contract may be less than that presented in point 3.1. point 3) of the SWZ, which, however, cannot be the basis for any claims of the Contractor against the Ordering Party. During the performance of the Agreement, the Ordering Party may commission a scope of work smaller than that indicated in the SWZ, but not less than 70% of the Value of the Subject of the Agreement determined in accordance with § 8 section 1 of the model contract constituting Annex 8 to the SWZ.

b) The remaining amount of aggregate will be collected depending on the actual needs of the Ordering Party.

(c) Deliveries shall be settled on the basis of the unit prices shown in the Tender and the quantities actually delivered. Therefore, the contractor's remuneration will change in proportion to the supplies actually made.

6) The Contractor is responsible for the implementation of the subject of the contract in accordance with the Act of 7 July 1994 Construction Law (consolidated text: Journal of Laws of 2020, item 1333, as amended) and the applicable Standards.

7) The Contractor bears full responsibility for getting acquainted with due diligence with the actual subject of the contract and for obtaining reliable information regarding the conditions and obligations that may in any way affect the value of the offer or the implementation of deliveries. The Contractor bears full responsibility for the consequences of the lack or erroneous recognition of the conditions for the performance of the contract and the state of the place of performance of the subject of the contract.

8) The Contractor is obliged to read the tender documentation (SWZ with attachments) and clarify any doubts at the stage of the procurement procedure and the preparation of the offer.

9) Additional information is contained in Chapter 3 of the SWZ and the annexes to the SWZ.
