1. The subject of the contract is the delivery of an oral rabies vaccine of free-living foxes to the Provincial Veterinary Inspectorates indicated in Chapter I, subchapter I of the SWZ.
2. The description of the subject of the contract, including the number of doses of vaccine for individual Provincial Veterinary Inspectorates and the manner of implementation of the subject of the contract are set out in Annex No. 1 to the SWZ constituting the Description of the subject of the contract and in Annex No. 2 to the SWZ constituting the Draft provisions of the contract.
1. The subject of the contract is the supply of an oral rabies vaccine for free-living foxes in the spring action and the autumn action in 2023 in the total amount of 7 723 306 doses, including 3 810 293 doses in the spring action and 3 913 013 doses in the autumn action.
2. The description of the subject of the contract and the manner of implementation of the subject of the contract are set out, respectively, in Annex 1 to the SWZ constituting the Description of the subject of the contract and in Annex 2 to the SWZ constituting the Draft provisions of the contract.
3. The Contracting Authority requires that to confirm that the offered vaccine meets the requirements set out in point II, point 2 of Annex 1 to the SWZ constituting the Description of the subject of the contract, the Contractor shall submit together with the offer the means of proof in question, i.e.:
1) Marketing authorisation for oral rabies vaccine for free-living red foxes together with all attachments, in particular the Summary of Product Characteristics of the veterinary medicinal product, issued by way of a decision of the minister competent for health or the President of the Office for Registration of Medicinal Products, Medical Devices and Biocidal Products or in accordance with Article 3(2) of the Pharmaceutical Law, authorisation issued by the Council of the European Union or the Commission European.
4. If the Contractor does not submit the said means of evidence referred to in paragraph 3 together with the bid or the evidence submitted is incomplete, the Contracting Authority shall call for their submission or supplementation within the prescribed period, unless despite the submission of the said evidence, the bid is subject to rejection or there are grounds for invalidating the proceedings. The contracting authority may request explanations regarding the content of the evidence in question.
5. As a result of the conducted proceedings, contracts will be concluded for each Provincial Veterinary Inspectorate separately, in accordance with the Draft provisions contained in Annex 2 to the SWZ.
6. The Contracting Authority may cancel the procurement procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it.
