Acting pursuant to Article 37(2) of the Act of 11 September 2019. Public Procurement Law (consolidated text: Journal of Laws of 2021, item 1129, as amended) [hereinafter: "PPL Act"] and in accordance with the Power of Attorney of 17 June 2022 of the Municipal Waste Management Enterprise of a limited liability company, the proceedings in question are conducted by:

1.The subject of the order includes:
– dismantling the existing old UNOTECH duct press and putting it back at the storage site,
– purchase and delivery with assembly of a brand new (i.e. manufactured in 2022) unused, complete, channel press with a perforator (hereinafter: "machine"),
− connection and commissioning of the machine under load,
– conducting free training of employees in its proper use and operation,
– service during the warranty period.
2. Place of disassembly, delivery and assembly of the above-mentioned machine: Miejskie Przedsiębiorstwo Gospodarki Odpadami Sp. z o.o., 41 – 216 Sosnowiec, 21 Grenadierów Street (hereinafter: "Plant").
3. The technical characteristics of the machine are described in detail in Annex 2 to the SWZ – "Means of proof in question – Specification of the product offered" in column 2. Table marked "TECHNICAL PARAMETERS – MINIMUM REQUIREMENTS OF THE ORDERING PARTY".
4.In accordance with Article 257 of the Public Procurement Law, the Contracting Authority reserves the right to cancel the procedure for the award of a public contract if the funds it intends to allocate to finance all or part of the contract have not been granted to it.
6. ECONOMIC OPERATORS JOINTLY APPLYING FOR THE AWARD OF A PUBLIC CONTRACT.
Economic operators may jointly apply for the award of a public contract. In such a case, the Contractors acting jointly are obliged to appoint a representative to represent them in the proceedings or to represent them in the proceedings and conclude a contract on the public contract in question. All correspondence will be conducted by the Ordering Party only with a proxy.
The condition regarding the right to conduct a specific business or professional activity (if formulated), referred to in Article 112(2)(2) of the PPL Act, will be met if at least one of the Contractors jointly applying for the award of the contract has the right to conduct a specific business or professional activity and performs the supplies for the implementation of which these rights are required.
In the case referred to in Chapter I, paragraph 4, point 4.2. SWZ, Contractors jointly applying for the award of a contract shall attach a statement to the tender, which shows which deliveries will be made by individual Contractors.
