1. Scope of the order:

Services of mowing grass and weeds in the road lanes of Provincial Roads administered by the WFD in Puławy:

Roads No: 801, 840, 845

2. Mowing multiplicity:

a. for roads No: 801 (section: from km 84+085 to km 92+030 and from km 101+560 to km 117+245), 845: maximum 2 times over the entire width of the road lane

b. for road No. 801 (bypass of Stężyca): maximum 4 times along the entire width of the road lane

c. for road No. 840: maximum 3 times along the entire width of the road lane

1.Technical and formal arrangements

a. The Contractor is obliged to perform the subject of the contract in accordance with the requirements set out in this SWZ, the contract and the Technical Specification, in a manner that guarantees proper quality.

b. The scope of the service subject of the Agreement shall include:

(a) Marking the place of work carried out in accordance with the approved project of temporary traffic organisation;

b) Removal of self-seeding and suckers from the area of the road strip along its entire width;

c) Mowing grass and weeds along the entire width of the road lane (green area, dividing lanes, roundabouts, shoulders with slopes, fenced areas with separators, fenced areas with rainwater tanks, areas under facilities, as well as grass and weed overgrowths on sidewalks, bicycle paths, bands, islands and asylums at curbs).

d) Mowing grass and weeds at the inlets of intersections with roads with bituminous surface over a length of 20 m from the edge of the provincial road and the entire width of their road lane;

e) Manual mowing of grass and weeds in places inaccessible to mowers, around infrastructure elements and road equipment located in the road lane;

f) Cleaning mowed grass and weeds from sidewalks, bicycle paths, roadways, bands, stairs, ditches, culverts and drainage elements (drains, grids, street drains, etc.);

The price of services indicated in point 3.b. should be included in the unit price of mowing (according to the price form template).

c. The location and approximate areas of mowing are specified in the bill of quantities annexed to the SWZ.

2. The Contracting Authority reserves the right without the need to change the contract, to which the Contractor agrees to change the scope of the contract by changing the size of the mowed area or the multiplicity of services performed and the right to reduce the scope of the contract.

3. The Contractor is obliged to ensure safe traffic conditions (pedestrian and pedestrian) in the area of the services covered by the contract on the basis of the project of temporary traffic organization.

4. Export and development of waste produced during the service carried out in accordance with the applicable waste regulations. All costs and liability related to the export and management of the waste generated shall be borne by the Contractor.

5. The Contractor shall, together with the invoice, provide the Contracting Party with a document confirming the correct management of the waste generated.

6. The remuneration for the services covered by the scope of the contract will be calculated on the basis of the unit price indicated in the tender.

7. The contractor shall be remunerated for the actual quantities of services rendered.

8. The subject of the contract is described in the manner laid down in Article 101 (1) (2) and paragraph 3 of the Law of the PZP Contracting Authority shall allow solutions equivalent to those described. Contractor who invokes equivalent solutions described provided that the Contractor demonstrates in the offer, in particular by means of the evidence in question referred to in Articles 104 to 107, that the proposed arrangements meet the requirements set out in the description object of the order.

9. The Ordering Party does not allow the possibility of submitting partial offers.

For the selected variant of the contract, its division into parts is not justified. This contract is not a major contract within the meaning of recital 78 of the cited EU Directive 2014/24/EU. The scope of the contract covers 36,764 ha of roadside mowing area, which, like similar contracts in previously announced proceedings, is awarded as one task, moreover. The designated road sections are located in a similar territory and the separation of the contract would risk irreversible organisational problems relating to the proper performance of the services and the responsibility for the various elements of the services provided by different economic operators.
