Technical description of the subject of the order.
1. The subject of the contract is the sale of diesel oil with a fixed quality standard according to PN-PN-EN 590:2022-08 and delivery of it by transport to the Contractor in quantities required by the Contracting Authority (one-time delivery of up to 5000 l), taking into account the parameters in summer and winter, depending on weather conditions.
2. Throughout the entire period of the order, diesel oil will be delivered directly to the Waste Management Plant in Nowy Sącz at 120 Tarnowska Street. The annual volume of diesel is determined to be no more than 300 000 litres. The final amount of diesel fuel will result from the actual needs of the Ordering Party during the term of the contract. The reduction in the amount of diesel fuel will not be the basis for any financial claims by the Contractor, provided that the Contracting Authority is obliged to collect at least 100,000 liters from the Contractor. Failure to collect this minimum amount shall be liable for damages under the general rules provided for by generally applicable law.
The minimum amount of fuel that the Contractor will provide to the Ordering Party is 100,000 liters.
3. The Contractor's car – tanker truck supplying diesel oil should meet the technical parameters in accordance with the current provisions of the Act of 19 August 2011 on the carriage of dangerous goods (i.e. Journal of Laws of 2022, item 2147 późn.zm) and the agreement on the international carriage of dangerous goods by road (i.e. Journal of Laws of 2023, item 891) regulating the method of transporting fuels, i.e. that during the term of the contract the tanker is of an agreed and unchangeable standard.
