Developing the functional and utility program, complete tender documentation (hereinafter referred to as Documentation) and conducting the tender procedure for the selection of the Contractor implemented in the 'design and build' formula of the Investment entitled "Expansion of the energy combustion installation at the Municipal Heating Plant in Łomża with a high-efficiency cogeneration system based on a biomass boiler" (hereinafter referred to as the Investment).

1. Preparation of the tender documentation and conducting the tender procedure.

Developing the functional and utility program, complete tender documentation (hereinafter referred to as Documentation) and conducting the tender procedure for the selection of the Contractor implemented in the 'design and build' formula of the Investment entitled "Expansion of the energy combustion installation at the Municipal Heating Plant in Łomża with a high-efficiency cogeneration system based on a biomass boiler" (hereinafter referred to as the Investment).

3.2. The tender documentation will be prepared and the tender procedure carried out based on and in accordance with:

- the Act of 29.1.2004 - Public Procurement Law (consolidated text: Journal of Laws of 2018, item 1986, as amended),

- guidelines currently in force regarding the eligibility of expenditure under the European Regional Development Fund, the European Social Fund and the Cohesion Fund for 2014-2020.

3.3. The functional and utility program will be implemented in accordance with the Regulation of the Minister of Infrastructure of 2.9.2004 regarding the detailed scope and form of design documentation, technical specifications for the execution and acceptance of construction works, and the functional and utility program (Journal of Laws from 2013, item 1129 ).

3.4. The Contractor is obliged to perform the contract on the terms and conditions described in these ToR, the draft contract constituting Annex 5 to the ToR, a description of the Employer's requirements constituting Annex 2 to the ToR and in accordance with the existing building design and building permit decision. The building permit decision will change with respect to the second stage: "Expansion of the fuel combustion installation at the Municipal Heating Plant in Łomża with a high-efficiency cogeneration system based on a biomass boiler" due to the height of the designed building, which must be increased.

3.5. For the above task, the Employer has a construction project and a building permit decision covering 2 investments in its scope:

a) "Expansion of the Municipal Heating Plant in Łomża with a 12.5 MW water boiler using biomass as fuel";

b) "Expansion of the fuel combustion installation at the Municipal Heating Plant in Łomża with a high-efficiency cogeneration system based on a biomass boiler".

3.6. Description of the Employer's requirements regarding the subject of the contract is included in Annex 2 to the ToR.

3.7. The subject of the order, according to CPV, includes:

a) 71000000-8 - Architectural, construction, engineering and inspection services,

b) 71240000-2 - Architectural, engineering and planning services,

c) 71541000-2 - Construction project management services,

d) 71241000-9 - Feasibility studies, consultancy services, analyzes,

e) 71242000-6 - Preparation of projects and projects, cost estimation,

f) 71320000-7 - Engineering services in the field of design.

3.8. The Contractor shall provide the Employer with developed Documentation:

a) in graphic form in 4 copies,

b) in an electronic version on a CD in 2 copies, recorded in the following formats, as appropriate:

Text documents - doc, pdf,

Text documents with graphics - doc, pdf,

Image files - jpg,

Calculation files - xls,

Technical drawings - dwg, pdf.
