The subject of the contract is the provision of a service of maintaining cleanliness and greenery in the Representative Centre of the Ministry of National Defence, the scope of which includes: 1) guaranteed contract: a) maintenance of greenery (care), cleanliness and order of the area of the palace and park complex in Helenów, entered in the register of monuments under reg. no. 1033/904 of 24.05.1971, b) maintaining cleanliness of paved and ground surfaces, c) maintaining cleanliness and order of the green belt and pavement adjacent to the area of the Representative Centre of the Ministry of National Defence in accordance with the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2022, item 2519, as amended); 2) optional order: a) mowing of agricultural land, and slopes of ponds, b) mineralization of the fire belt, c) keeping the external fence clean.

A detailed description of the subject of the contract specifies: 1) description of the subject of the contract: Annex 1a to the SWZ (guaranteed order) and Annex 1b to the SWZ (optional order); 2) model contract - Annex 9 to the SWZ. 2. Pursuant to Article 95(1) of the Act, the Contracting Authority requires the Contractor or Subcontractors to employ persons performing direct activities in the performance of the service on the basis of an employment relationship, because the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2022, item 1510, of late. Deaths). Pursuant to Article 95(2) of the Act, the contracting authority shall specify the type of activities related to the performance of the contract to which the employment requirements apply: 1) direct supervision activities; 2) direct physical activities related to the performance of gardening and cleaning (cleaning); 3) direct physical activities related to the mineralization of the fire belt and maintaining the cleanliness of the fence.
