1. The subject of the contract is the provision of search services and entry into the database on the contact platform personal data and CV total 100 candidates for work.
2. Detailed description of the subject matter of the contract is specified in the OPZ (Annex 1 to the SWZ) and in the model contract (Annex 2 to the SWZ).
3. The Contracting Authority shall not allow the possibility of submitting partial tenders. The service includes searching and entering into the database on the contact platform personal data and CV total 100 job candidates. It is not possible for several contractors to perform the order.
Contractors who can apply for the contract:
1. They are not subject to exclusion under Article 108 (1) of the Pzp Act, whereby the contractor is excluded from the procurement procedure:
1) being an individual who was legally convicted of a crime:
(a) participation in an organised criminal group or union aiming to commit an offence or treasury offence referred to in Article 258 of the Criminal Code,
(b) trafficking in human beings referred to in Article 189a of the Criminal Code,
(c) referred to in Articles 228-230a, 250a of the Criminal Code or Article 46 or Article 48 of the Act of 25 June 2010 on Sport,
(d) the financing of an offence of a terrorist nature referred to in Article 165a of the Criminal Code, or the offence of thwarting or obstructing the criminal origin of money or concealing its origin as referred to in Article 299 of the Criminal Code,
(e) of a terrorist nature referred to in Article 115 (20) of the Criminal Code, or intended to commit that offence,
(f) entrusting the performance of work to a minor alien referred to in Article 9 (2) of the Act of 15 June 2012 on the effects of entrusting the performance of work to foreigners in defiance of regulations in the territory of the Republic of Poland (Journal of Laws item 769),
(g) against economic turnover referred to in Articles 296-307 of the Criminal Code, the offence of fraud referred to in Article 286 of the Criminal Code, the offence against the reliability of the documents referred to in Articles 270-277d of the Criminal Code, or the treasury offence,
(h) referred to in Article 9 (1) and (3) or Article 10 of the Act of 15 June 2012 on the effects of entrusting the performance of work to foreigners in defiance of the provisions in the territory of the Republic of Poland
- or for an appropriate prohibited act specified in the provisions of foreign law;
2. if the incumbent member of his governing or supervisory authority, the partner of the company in a public or partnership or a complementary in a limited partnership or limited partnership or a prosecutor has been legally convicted of the offence referred to in point 1;
3) against which a legitimate judgment of the court or final administrative decision has been given to the payment of taxes, fees or social or health contributions, unless the contractor appropriately prior to the expiry of the deadline for lodging applications for admission to participate in the proceedings or before the deadline for submission of tenders, he has made payments of taxes, fees or social or health contributions due together with interest or fines, or entered into a binding agreement on the repayment of those receivables;
4) against which the prohibition of public procurement was legally ruled;
5) if the contracting authority can conclude, on the basis of credible indications, that the contractor has concluded an agreement with other contractors to distort competition, in particular if belonging to the same capital group within the meaning of the Act of 16 February 2007 on the protection of competition and consumers have submitted separate tenders, partial tenders or applications for admission to the proceedings, unless they show that they have prepared these offers or applications independently of each other;
6) if, in the cases referred to in Article 85 (1), there has been a distortion of competition arising from the prior involvement of that contractor or entity that belongs with the contractor in the same capital group within the meaning of the Act of 16 February 2007 on the Protection of Competition and consumers, unless the distortion of competition caused may be eliminated other than by excluding the contractor from participating in the procurement procedure,
and the exclusion of the Contractor shall be pursuant to Articles 110 and 111 of the Pzp Act, insofar as those provisions relate to mandatory exclusion conditions.
