The subject of the contract is the purchase of electricity by the Ordering Parties and their organizational units with a total estimated volume of 20,201.75 MWh (+/- 10%) during the delivery period, i.e. from 01.01.2023 to 31.12.2023.

2.The Contractor shall make all the actions and arrangements with the DSO necessary to carry out the procedure to change the seller and effectively start the sale of electricity, including in particular: termination of existing comprehensive contracts, notification to the DSO of new contracts for the sale of energy electric. These actions shall be carried out by the Contractor on the basis of the relevant powers of attorney granted with the conclusion of contracts for the sale of electricity.
3.The indicated positive or negative tolerance regarding the volume of electricity being the subject of the contract should be understood as the right of option within the meaning of Article 441 of the PPL Act. The Ordering Parties reserve the right to unilaterally extend or reduce the order within the right of option in the amount of not more than 10% of the total volume being the subject of the procedure. The exercise of the right resulting from the option will take place automatically through the energy consumption of individual PPEs and their subsequent settlement by the Contractor.
4.The sale of energy will take place on the basis of contracts concluded separately by individual Contracting Authority and, in the case of Territorial Units, also on the basis of contracts entered into separately by local government organisations, which will be separate payers and which are detailed in Annex 2 to SWZ.
5.The sale of electricity will take place under the conditions set out in the Energy Law of 10 April 1997 (Journal of Laws of 2022, item 1385, as amended) and on the basis of the implementing provisions to this Act, in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the functioning of the power system (Journal of Laws of 2007 No. 93, item 623 from late. as amended), the Regulation of the Council of Ministers of 23 July 2007 on the detailed rules and procedures for introducing restrictions in the sale of solid fuels and in the supply and consumption of electricity or heat (Journal of Laws of 2021, item 2209), the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and settlements in electricity trading (Journal of Laws of 2019, item 503, as amended), the rules set out in the concessions, in accordance with the provisions of the terms of the contract as well as in accordance with the Contractor's offer and in accordance with the provisions of the Civil Code.
6.In this tender procedure, all energy consumption points (PPE) have been divided into 2 groups, for which the Ordering Party expects to differentiate the unit prices of electricity submitted in the offer. The expected variation is due to the different energy consumption profile in these groups.
7.Characteristics of the segregated groups:
Group 1 Street lighting All street lighting objects whose work is automatically controlled by systems based on astronomical clocks or photoelectric devices. Objects can belong to OSD tariff groups: Bxx, Cxx, O1x, R.
Group 2 Venues and objects other than street lighting All other objects not part of Group 1 belonging to distribution tariff groups: Bxx, Gxx, C1x, C2x, R
