"Collection, removal and management of municipal waste selectively collected from the area of the City and Commune of Muszyna Uzdrowiskowa"

1. The subject of the contract is "Collection, removal and management of municipal waste collected separately from the area of the City and Commune of Muszyna Uzdrowiskowa"

2. The Awarding Entity allows submission of partial offers for specific tasks:

A. TASK No. 1 PLASTICS - Collection, removal and neutralization of waste

B. TASK NO. 2 PLASTICS - waste disposal

C. TASK NO. 3 LARGE-SIZE WASTE - Collection, removal and disposal of waste

D. TASK NO. 4 LARGE bulky waste - Disposal of waste

E. TASK NO. 5 BIODEGRADABLE WASTE - Waste disposal

F. TASK NO. 6 WASTE TIRES

G. TASK NO. 7 TIMED MEDICINES

TASK No. 1 PLASTICS - Collection, removal and neutralization of waste

1) The subject of the contract includes the provision of services for the collection, export and disposal of plastic waste from selective collection in the amount of approx. 30.00 Mg (tonnes), in accordance with the requirements set out in the Waste Act of December 14, 2012 together with implementing acts. .

2) As part of the contract, the Contractor is obliged in particular to:

a) delivery to a designated place in the area of the Town and Commune of Muszyna Spa min. two containers with a capacity of min. 30-35 m3 for waste disposal;

b) collection of waste classified in the waste catalog under codes 20 01 39, 15 01 02, 15 01 05, 20 01 40, 15 01 04;

c) collecting successively full containers and leaving empty. The Employer will notify the Contractor of the need to collect waste by phone. The pickup will take place from the place designated by the Employer in the area of the Town and Commune of Muszyna, among others from the sewage treatment plant in Muszyna and the Selective Municipal Waste Collection Point in Powroźnik, on business days during the Employer's business hours, i.e. from Monday to Friday from 7:00 to 15:00. The waste is loaded into containers by the Employer;

d) as part of the collection procedure, the Contractor undertakes to remove from the cars used to transport empty containers for substitution and to load containers with waste on these cars.

e) disposal and disposal of plastic waste.

3) The Contractor's obligations include ensuring:

a) permanent and legible marking of cars, in a visible place, company name as well as address and telephone number of the Contractor;

b) protection against uncontrolled escape of waste during storage, handling and transport;

c) vehicle construction that will protect against dispersion and spraying of transported waste and minimize the impact of atmospheric factors on waste;

d) vehicles used for the transport of waste that meet the detailed requirements for vehicles, in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners.

4) In 2020, approximately 30.00 tons of plastic waste collected separately are planned to be removed from the area of the City and Commune of Uzdrowiskowa Muszyna.

5) The Ordering Party reserves that the given amounts are estimated quantities, illustrate the possible size and scope of the subject of the contract and may be helpful at the stage of preparing the offer. The amounts of waste indicated are an approximate value calculated according to the amount of waste collected in previous years (including the expected increase in the amount of waste). The Employer reserves the right to reduce or increase the amount of waste transferred in relation to calculations from previous years, depending on actual needs without the Contractor's right to compensation claims in this respect. The Purchaser does not guarantee the above amount of waste during the year.

6) During the Order, an increase or decrease in the number of households from which waste will be collected by about 15% is expected.

7) The Ordering Party reserves the right to increase the total amount of collection, export and disposal of plastic waste from selective collection depending on the demand by up to 25% (hereinafter "Optional Quantity") - using the option right referred to in Art. 34 section 5 of the PPL Act (hereinafter the "Option Law"). The exercise of the option right by the Employer is the Employer's right and depends on the actual needs of the Employer.

8) The option right is the Employer's entitlement, which the Employer may or may not use as part of the contract. If the Employer fails to exercise the option right, the Contractor shall not be entitled to any claims in this respect.


TASK NO. 2 PLASTICS - waste disposal

1) The subject of the contract includes the provision of a service for the disposal of plastic waste from selective collection in the amount of approx. 220.00 Mg (tonnes), in accordance with the requirements set out in the Waste Act of December 14, 2012 together with implementing acts.

2) As part of the contract, the Contractor is obliged in particular to:

a) accepting wastes classified in the waste catalog under codes 20 01 39, 15 01 02, 15 01 05, 20 01 40, 15 01 04 at recovery or disposal points;

b) mechanical treatment of accepted waste;

c) management of secondary raw materials from the received waste;

d) neutralizing residues from mechanical treatment of received waste.

3) In 2020, approximately 220.00 Mg (tonnes) of plastic waste collected separately are planned to be removed from the area of the City and Commune of the Health Resort Muszyna.

4) The Ordering Party reserves that the given amounts are estimated quantities, illustrate the possible size and scope of the subject of the contract and may be helpful at the stage of preparing the offer. The amounts of waste indicated are an approximate value calculated according to the amount of waste collected in previous years (including the expected increase in the amount of waste). The Employer reserves the right to reduce or increase the amount of waste transferred in relation to calculations from previous years, depending on actual needs without the Contractor's right to compensation claims in this respect. The Purchaser does not guarantee the above amount of waste during the year.

TASK NO. 3 LARGE-SIZE WASTE - Collection, removal and disposal of waste

1) The subject of the contract includes the provision of services for the collection, export and disposal of bulky waste in the amount of approx. 40.00 Mg (tonnes), in accordance with the requirements set out in the Waste Act of December 14, 2012 together with implementing acts.

2) As part of the contract, the Contractor is obliged in particular to:

a) delivering containers with a capacity of min. to the designated place in the City and Commune of Muszyna 30-35 m3 for waste disposal;

b) collection of waste classified in the waste catalog under codes 20 03 07;

c) collecting successively full containers and leaving empty. The Employer will notify the Contractor of the need to collect waste by phone. The pickup will take place from the place designated by the Employer in the area of the Town and Commune of Muszyna, among others from the sewage treatment plant in Muszyna and the Selective Municipal Waste Collection Point in Powroźnik, on business days during the Employer's business hours, i.e. from Monday to Friday from 7:00 to 15:00. The waste is loaded into containers by the Employer;

d) as part of the collection procedure, the Contractor undertakes to remove from the cars used to transport empty containers for substitution and to load containers with waste on these cars;

(e) transport of waste to recovery or disposal points;

3) The Contractor's obligations include ensuring:

c) vehicles used for the transport of waste that meet the detailed requirements for vehicles, in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners.

4) All costs related to the performance of services constitute the Contractor's obligation, including the costs of loading containers containing waste on cars for transport will be borne by the Contractor.

5) The Ordering Party reserves that the given amounts are estimated quantities, illustrate the possible size and scope of the subject of the contract and may be helpful at the stage of preparing the offer. The amounts of waste indicated are an approximate value calculated according to the amount of waste collected in previous years (including the expected increase in the amount of waste). The Employer reserves the right to reduce or increase the amount of waste transferred in relation to calculations from previous years, depending on actual needs without the Contractor's right to compensation claims in this respect. The Purchaser does not guarantee the above amount of waste during the year.

6) The Awarding Entity reserves the right to increase the total amount of collection, export and disposal of bulky waste depending on the demand by a maximum of 25% (hereinafter "Optional Quantity") - using the option right referred to in Art. 34 section 5 of the PPL Act (hereinafter the "Option Law"). The exercise of the option right by the Employer is the Employer's right and depends on the actual needs of the Employer.

7) The option right is the Employer's right, which the Employer may or may not use as part of the contract. If the Employer fails to exercise the option right, the Contractor shall not be entitled to any claims in this respect.


TASK NO. 4 LARGE-SIZE WASTE - Waste disposal

1) The subject of the contract includes the provision of a service for the disposal of bulky waste in the amount of approx. 300.00 Mg (tonnes), in accordance with the requirements set out in the Waste Act of December 14, 2012 together with executive acts.

2) As part of the contract, the Contractor is obliged in particular to:

a) an indication of the place of bulky waste management for the waste classified under codes: 20 03 07;

b) accept bulky waste at the recovery or disposal point;

c) mechanical treatment of accepted waste;

d) management of secondary raw materials from the received waste;

e) neutralizing residues from mechanical treatment of received waste.

3) The Ordering Party reserves that the given amounts are estimated quantities, illustrate the possible size and scope of the subject of the contract and may be helpful at the stage of preparing the offer. The amounts of waste indicated are an approximate value calculated according to the amount of waste collected in previous years (including the expected increase in the amount of waste). The Employer reserves the right to reduce or increase the amount of waste transferred in relation to calculations from previous years, depending on actual needs without the Contractor's right to compensation claims in this respect. The Purchaser does not guarantee the above amount of waste during the year.

4) The Employer reserves the right to increase the total amount of bulky waste depending on the demand by a maximum of 25% (hereinafter "Optional Quantity") - using the option right referred to in Art. 34 section 5 of the PPL Act (hereinafter the "Option Law"). The exercise of the option right by the Employer is the Employer's right and depends on the actual needs of the Employer.

5) The option right is the Employer's right, which the Employer may or may not use as part of the contract. If the Employer fails to exercise the option right, the Contractor shall not be entitled to any claims in this respect.


TASK NO. 5 BIODEGRADABLE WASTE - Waste disposal

1) The subject of the contract includes the provision of a service for the disposal of biodegradable municipal waste in the amount of approx. 30.00 Mg (tonnes) to RIPOK for KOMPOSTECH installations in Nowy Sącz, in accordance with the requirements set out in the Waste Act of December 14, 2012 together with executive acts. .

2) As part of the contract, the Contractor is obliged in particular to:

a) collection of biodegradable municipal waste classified under codes: 20 02 01, 20 01 08 from the place indicated by the Employer. Loading works of biodegradable waste into containers are carried out by the Employer;

b) removal of biodegradable municipal waste by means of transport adapted for this purpose. The Employer will notify the Contractor of the need to export biodegradable waste by phone. Collection of waste will take place from the place designated by the Employer in the area of the City and Commune of Muszyna on business days during working hours of the Employer, i.e. from Monday to Friday from 7:00 to 15:00.

c) leaving containers for loading on the loading yard by removing them from carriers / motor vehicles.

3) The Contractor's obligations include ensuring:

a) permanent and legible marking of cars, in a visible place, company name as well as address and telephone number of the Contractor;

b) protection against uncontrolled escape of waste during storage, handling and transport;

c) vehicle construction that will protect against dispersion and spraying of transported waste and minimize the impact of atmospheric factors on waste;

d) vehicles used for the transport of waste that meet the detailed requirements for vehicles, in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners.

4) The Ordering Party reserves that the given amounts are estimated quantities, illustrate the possible size and scope of the subject of the contract and may be helpful at the stage of preparing the offer. The amounts of waste indicated are an approximate value calculated according to the amount of waste collected in previous years (including the expected increase in the amount of waste). The Employer reserves the right to reduce or increase the amount of waste transferred in relation to calculations from previous years, depending on actual needs without the Contractor's right to compensation claims in this respect. The Purchaser does not guarantee the above amount of waste during the year.

5) The Employer reserves the right to increase the total amount of collection, export and disposal of biodegradable waste, depending on the demand, by up to 25% (hereinafter "Optional Quantity") - using the option right referred to in Art. 34 section 5 of the PPL Act (hereinafter the "Option Law"). The exercise of the option right by the Employer is the Employer's right and depends on the actual needs of the Employer.

6) The option right is the Employer's right, which the Employer may or may not use as part of the contract. If the Employer fails to exercise the option right, the Contractor shall not be entitled to any claims in this respect.


TASK NO. 6 WASTE TIRES

1) The subject of the contract includes the collection of waste tires in the amount of approx. 25.00 Mg (tons) from the Selective Municipal Waste Collection Point in the City and Commune of Muszyna Uzdrowiskowa.

2) The subject of the contract includes waste classified under the codes: 16 01 03.

3) As part of the contract, the Contractor is obliged in particular to:

a) delivery to the designated place of containers with a capacity of min. 30-35 m3 for waste disposal. Containers will be collected gradually after filling. The waste is loaded into containers by the Employer.

b) placing containers for loading by the Contractor on the loading yard by removing them from carriers / vehicles;

c) collecting waste from the place indicated by the Employer in the area of the City and Commune of Muszyna and its transport to recovery or disposal points. The Contractor undertakes to collect waste from the place designated by the Employer in the area of the Town and Commune of Muszyna. The Employer may change the place of waste collection by indicating to the Contractor in writing a new place of waste collection; in the event of a change, the Contractor shall not be entitled to additional remuneration or other claims in this respect;

d) The Contractor undertakes to collect the waste from the Selective Municipal Waste Collection Point each time to leave the same collection of empty containers at the place of receipt, instead of the received containers containing waste;

e) mechanical treatment of received waste;

f) management of secondary raw materials from waste collected;

g) disposal of residues from mechanical treatment of received waste.

4) The obligations of the Contractor include:

a) permanent and legible marking of cars, in a visible place, company name as well as address and telephone number of the Contractor;

b) protection against uncontrolled escape of waste during storage, handling and transport;

c) vehicle construction that will protect against dispersion and spraying of transported waste and minimize the impact of atmospheric factors on waste;

d) vehicles used for the transport of waste that meet the detailed requirements for vehicles, in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners.

5) All costs related to the performance of services constituting the Contractor's commitment, including the costs of loading containers containing waste on cars for transport will be borne by the Contractor.

The amounts of waste indicated are an approximate value calculated according to the amount of waste collected in previous years (including the expected increase in the amount of waste). The Employer reserves the right to reduce or increase the amount of waste transferred in relation to calculations from previous years, depending on actual needs without the Contractor's right to compensation claims in this respect. The Purchaser does not guarantee the above amount of waste during the year.

7) The Ordering Party reserves the right to increase the total amount of collection, export and disposal of waste of used tires from selective collection depending on the demand by up to 25% (hereinafter "Optional Quantity") - using the option right referred to in Art. 34 section 5 of the PPL Act (hereinafter the "Option Law"). The exercise of the option right by the Employer is the Employer's right and depends on the actual needs of the Employer.

8) The option right is the Employer's entitlement, which the Employer may or may not use as part of the contract. If the Employer fails to exercise the option right, the Contractor shall not be entitled to any claims in this respect.


TASK NO. 7 TIMED MEDICINES

1) The subject of the contract includes the provision of services for specialized containers for collection of expired medicines, collection, transport and disposal of expired medicines from pharmacies, pharmacy points located within the administrative boundaries of the Muszyna Commune, indicated in Annex No. 1 to the ToR. The subject of the contract includes waste classified under the following codes: 20 01 31.

2) The Awarding Entity reserves the right to indicate additional, other than those listed in Annex 1 to the ToR, waste collection points during the course of the contract, if such a need arises.

3) The estimated amount of overdue medicines to be collected throughout the entire duration of the contract will be around 0.4 Mg (tonnes).

4) Expired medicines will be collected in specialized containers to collect expired medicines.

5) Collection of waste from individual pharmacies and pharmacy outlets will take place once a quarter and in addition if there is such need within 7 days of notification by the Employer.

6) The obligations of the Contractor include:

a) protection against uncontrolled release of waste during storage, handling and transport;

b) vehicle construction that will protect against dispersion and spraying of the transported waste and minimize the impact of atmospheric factors on the waste.

The Purchaser does not guarantee the above amount of waste during the year.

8) The Purchaser reserves the right to increase the total amount of collection, export and disposal of waste of out-of-date medicines, depending on the demand, by up to 25% (hereinafter "Optional Quantity") - using the option right referred to in Art. 34 section 5 of the PPL Act (hereinafter the "Option Law"). The exercise of the option right by the Employer is the Employer's right and depends on the actual needs of the Employer.

9) The option right is the Employer's right, which the Employer may or may not use as part of the contract. If the Employer fails to exercise the option right, the Contractor shall not be entitled to any claims in this respect.


TASK NO. 8 SANDS AND SCREENS

1) The subject of the contract includes the provision of collection, export and disposal services for waste with codes in accordance with the Regulation of the Minister of the Environment of December 9, 2014 regarding the waste catalog, i.e. screenings 19-08-01 in the amount of 14 Mg (tonnes) and content of sandboxes 19 -08-02 in the amount of 21 Mg (tonnes) from sewage treatment plants in Muszyna, Andrzejówka and Żegiestów.

2) The amount of generated waste depends on the amount and quality of wastewater delivered to treatment plants.

3) As part of the contract, the Contractor is obliged in particular to:

a) leaving for loading min. 2 metal containers with a capacity of 20 m 3 on the loading yard by removing them from carriers / motor vehicles. The waste is loaded into containers by the Employer.

b) collection of screenings and sandpit content from the place indicated by the Employer, i.e. sewage treatment plant in Muszyna, Andrzejówka and Żegiestów. The Employer will notify the Contractor of the need to collect waste by phone. Collection of waste will take place from the place designated by the Employer in the area of the Town and Commune of Muszyna within two days from the date of receiving telephone information from the Employer, from Monday to Friday, from 7:00 to 14:00.

c) export of screenings and sandstone contents adapted for this purpose.

d) neutralizing sludge in the form of screenings with code 19-08-01 and content of sand pit with code 19-08-02 from the sewage treatment plant in Muszyna, Andrzejówka and Żegiestów.

4) The obligations of the Contractor include:

a) permanent and legible marking of cars, in a visible place, company name as well as address and telephone number of the Contractor;

b) protection against uncontrolled escape of waste during storage, handling and transport;

c) vehicle construction that will protect against dispersion and spraying of transported waste and minimize the impact of atmospheric factors on waste;

d) vehicles used for the transport of waste that meet the detailed requirements for vehicles, in accordance with the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners;

e) vehicles that meet the requirements of the law, in particular they are airtight (they do not cause leaks), stable (they prevent the sedimentation, screenings and contents of sand traps and their penetration outside the vehicle), have a load capacity and strength adapted to the export of screenings and content grit.

5) The Ordering Party reserves that the given amounts are estimated quantities, illustrate the possible size and scope of the subject of the contract and may be helpful at the stage of preparing the offer. The amounts of waste indicated are an approximate value calculated according to the amount of waste collected in previous years (including the expected increase in the amount of waste). The Employer reserves the right to reduce or increase the amount of waste transferred in relation to calculations from previous years, depending on actual needs without the Contractor's right to compensation claims in this respect. The Purchaser does not guarantee the above amount of waste during the year.

6) In the case of disposal of waste through storage at a landfill, the Contractor undertakes to draw up the basic characteristics of the waste submitted by the Employer and perform compliance tests of the above waste.

7) The basic characteristics of the waste and compliance tests will be carried out by the Contractor in accordance with the Regulation of the Minister of Economy of 16 July 2015 on the admission of waste to landfill. In order to prepare the aforementioned characteristics, the Employer undertakes to provide information to the Contractors regarding the method of managing the generated waste, including a description of waste generation processes.
