The subject of the contract is the delivery of a brand new (year of manufacture 2022) wheeled excavator – 1 piece.

Detailed technical conditions are described in Annex 1 to the SWZ. The excavator should be brand new (year of manufacture 2022) Wheeled excavator – pcs.1.

It should have a European Union Declaration of Conformity CE and comply with the standards of the Machinery Directive 2006/42/EC.

Warranty and service conditions:

1. The Contractor shall provide warranty and post-warranty service of the excavator. 2. Guarantee for the subject of the contract as to its quality, compliance with all applicable standards and legal regulations in force in Poland, for a period of not less than 12 months from the moment of handing over the device to the Ordering Party after confirmation of the delivery and acceptance protocol without comments at the place of location, i.e. State Forests Forest Transport Centre at 10 Poznańska Street in Świebodzin. 3. When signing the contract, the Contractor is obliged to present the manufacturer's authorization documents for the performance of maintenance activities - a statement from which it will appear that the performance of warranty services by the Contractor will not deprive the Ordering Party of the manufacturer's warranty. 4. The warranty covers damage caused during proper operation of the delivered device in accordance with the instruction manual. 5. All costs related to the implementation of the guarantee shall be borne by the Contractor. 6. The Contractor undertakes towards the Ordering Party to satisfy all claims arising from non-performance or improper performance of the subject of the contract on the basis of the applicable provisions of the Civil Code on compensation and warranty for physical and legal defects and quality guarantee. 7. Time of diagnosis for a reported failure – not longer than 72 hours from the moment of reporting the failure by the Ordering Party. 8. The maximum time for removing the failure not longer than 14 calendar days from the date of reporting the failure, and in justified objective cases within the time limit agreed with the Ordering Party counting from the date of diagnostics. 9. Service under warranty, including service inspections – 5 working days from the date of e-mail notification by the Ordering Party. 10. The distance of an authorized stationary service point is not more than 150 km from the headquarters of the ordering party. During the warranty, transport of the excavator to the service point free of charge with effort and at the expense of the seller.

Obligations of the Contractor (attaching to the handover protocol at its own expense):

1. Warranty card (for the machine, components and installed devices) and service card, in Polish (PL) – delivered at the time of delivery. 2. Manual of systematic operation (daily, weekly, etc.), operating and maintenance manuals, and a set of technical, operational and organizational documentation in Polish (PL). 3. Fuel consumption standards in Polish (PL). 4. CE declaration of conformity in Polish (PL). 5. EC declaration of conformity in Polish (PL). 6. Lists of parts replaced during technical inspections and their prices (during the warranty period), in Polish (PL). 7. Spare parts catalogue and maintenance schedule, in Polish (PL) (English or German is allowed, access to catalogues on-line) 8. First aid kit at least DIN 13164 "equivalent people", ADR first-aid kit (for securing leakage of operating fluids into the ground)
