The contract has as its object the assignment of architectural and engineering services for the activities of architectural, structural and plant management and the coordination of safety during execution in relation to the building renovation contract, through demolition and reconstruction, of the municipal swimming facility called Piscina Fiammetta – Type of building NZEB
The activity of Works Management and Safety Coordination during the execution phase, must be carried out in accordance with the provisions of articles 114 and 115 of Legislative Decree 36/2023, Annex II.14 of the Code, Ministerial Decree no. 49/2018 as applicable and Legislative Decree 81/2008 and subsequent amendments, to which reference is made in full.
The Works Management is responsible for the technical, accounting and administrative control of the execution of the intervention also through methods and tools of digital information management referred to in Annex I.9 of the Code, to carry out the works in a workmanlike manner and in accordance with the project and the contract.
It is established that the Works Management and the Safety Coordinator during the execution phase, in carrying out the contracted service, must pay attention to the management of materials, means, equipment and management of demolition waste in compliance with the D.N.S.H. principles and the current minimum environmental criteria (CAM) referred to in Ministerial Decree 23/06/2022.
In the execution of contracts, the Works Management operates in full autonomy and in compliance with the service provisions issued by the RUP, evaluating and taking care of the technical, accounting and administrative profiles in the exclusive interest of the efficient and prompt execution of the intervention.
In the exercise of the functions entrusted, the Works Management assumes responsibility for coordinating and supervising the activities of the entire DL office and speaks exclusively with the executor regarding the technical and economic aspects of the contract.
On the part of the Works Management and Safety Coordination during the Execution phase, a constant presence must be guaranteed at the execution site of the works, providing no less than one inspection every 3 (three) days (n. 2 inspections per week), to be documented through annotations (also on the Work Journal), minutes and / or supporting photographic documentation regarding what has been detected, checked, given and disposed of, and, where appropriate, decisions taken and measures taken.
The contracted amount is fixed and invariable even in the event of design changes that have repercussions on the amount of the work taken as a basis for calculating the parcel.
The fee for the service includes all expenses related to travel to the construction site or the office of the RUP (travel, road expenses, vehicles, board and lodging, etc.) necessary to carry out the planned activity in question.
Pursuant to Article 58 of the Code of Contracts, the contract was not divided into lots due to the very nature of the architecture and engineering service to be performed, understood as a service
unique, aimed at creating a set of services that must have their own functional coherence.
Since these are services of an intellectual nature, the amount of security charges from risks from interference is zero and the Single Document for the Assessment of Interfering Risks (DUVRI) is not drawn up, in accordance with the provisions of art. 26, paragraph 3-bis, of Legislative Decree 81/2008 and further specified by the Determination of the Supervisory Authority on public contracts for works, services and supplies no. 3 of 05/03/2008.
The remuneration for the architecture and engineering services in question will be determined by applying the single percentage discount offered during the tender calculated in accordance with the provisions of the Ministerial Decree of 17 June 2016 as amended by Legislative Decree 36/2023 annex I.13, in force from 1 July 2023
