The contract concerns the maintenance service of green areas to be carried out at the headquarters of the System Environment Province of Naples SpA with a single member.

The performances deducted in the contract, due to their homogeneity, do not allow the subdivision into main and secondary services. The characteristics of the service are better described in the technical specification.

The presumed duration of the contract is set at 36 months starting from the effective start date of the activities, which must be recorded in a separate adversarial report, subject to exhaustion, before the contractual expiry, of the relative amount. There are no options.

It is represented that the art. 14, paragraph 3, of the regional law 5.4.2016 n. 6, published in the Official Bulletin of the Campania Region n. 22 of 5.4.2016, established that "in the transitional phase of reorganization of the waste cycle, pending the assignments that will be arranged by the Government Bodies in the optimal areas, the activities attributed to the provincial companies pursuant to the current regulations continue". Therefore, the Principal will continue to carry out its institutional activity, based on the regulatory provision, up to the possible identification of a new service manager.

Given the above, it is shown that the present tender procedure is subject to the provisions of art. 40 of the Regional Law n. 26.5.2016, n. 14, published in the BURC n. 33 of 26.5.2016, therefore, the identification, by the body of the area, of the new manager of the integrated service determines the express and automatic termination of the assignment.

The new service manager will have the right to continue or not to continue in the activities related to the contract.

The start of the service is expected, presumably, for 2.5.2019.

The RUP may authorize the final execution of the services covered by the contract, pursuant to art. 32, paragraphs 8 and 13, of Legislative Decree 50/2016.
