The subject of the contract are dredging works with a length of 6600 m, on the section from km 6+600 to km 0+000 and dredging works with a length of 2000 m on the section from point P1 to P2 along with the performance of research and cleaning of the river bed of ferromagnetic obstacles and the implementation of navigation markings in the form of 8 buoys (4 rolled red on the left and 4 conical green on the right) on this section. This task is part of the waterway and covers the fairway on the Elbląg River.

Construction works covered by the subject of the contract should be performed in accordance with the OPZ (Annex No. 12 to the SWZ) and the technical documentation constituting Annexes 13 - 17 to the SWZ.

1. The subject of the contract are dredging works with a length of 6600 m, on the section

from km 6+600 to km 0+000 and dredging works with a length of 2000 m on the section

from point P1 to P2 along with testing and cleaning the river bed of ferromagnetic obstacles and making navigation markings in the form of 8 buoys

(4 rolled red on the left and 4 conical greens on the right) on this section. This task is part of the waterway and covers the fairway on the Elbląg River.

2. Construction works covered by the subject of the contract should be carried out in accordance with the OPZ (Annex 12 to the SWZ) and the following documentation:

1) Design (construction and executive) of the fairway on the Elbląg River (Annex 13 to the SWZ)

2) Architectural and construction design "Construction of a fairway on the Elbląg River on the section P1-P2 – Stage 1" (Annex 14 to the SWZ)

3) Technical specifications - industries: hydrotechnical, energy, teletechnical and sanitary (Annex No. 15 to SWZ)

4) Report on ferromagnetic tests carried out for the needs of the project "Construction of a waterway connecting the Vistula Lagoon with the Gulf of Gdańsk". Planned fairway on the Elbląg River (Annex 16 to the SWZ)

3. During the execution of works, the Contractor must comply with the conditions resulting from the decisions constituting Annex 17 to the SWZ, i.e.:

- Decision of GDOŚ mark DOOŚ-WDŚ/ZOO.420.6.2019.mko.52 of 17 September 2020

- Decision of RDOŚ in Olsztyn mark:WOOŚ.420.17.2022.AZ.25 of 31.03.2023

- Decision of RDOŚ in Olsztyn mark: WOOŚ.4211.1.2017.AZ.67 of December 5, 2018

4. Essential provisions of the agreement have been included in the draft agreement, constituting Annex 4 to the SWZ

5. The Contracting Authority shall require that the Contractor holds, throughout the entire period of performance of the contract, civil liability insurance in the scope of its business activity (third party liability policy) related to the subject of the contract – as a separate policy or section in the CAR policy, for the sum insured not less than the amount of remuneration for the performance of the subject of the contract.

6. Pursuant to Article 95(1) of the PPL, the contracting authority requires the contractor or subcontractor to employ persons who will perform the activities described in Paragraph 2(21) of the draft contract. The method of documenting employment is specified in § 2 clause 24 of the draft contract. The rights of the Contracting Authority in the scope of control are specified in § 2 clauses 25-26 of the draft contract. Penalties for failure to comply with these requirements are set out in § 17(1)(8) of the draft contract.

7. The contracting authority provides for the possibility of awarding contracts pursuant to Article 214(1)(7) of the PPL, consisting in the repetition of similar construction works, consistent with the subject of the contract, up to the amount not exceeding PLN 35,822,685.92 net.
