III. DESCRIPTION OF THE SUBJECT OF THE CONTRACT
1. The subject of the contract is: waste management service from Selective Municipal Waste Collection Points (PSZOK) run by the Ordering Party. The order was divided into two lots:
PART I – waste management code 17 01 07 – mixed waste of concrete, brick rubble, waste ceramics and equipment other than those mentioned in 17 01 06. Waste delivered with code 17 01 07 will be in the form of "bulk",
PART II - waste management code 20 03 07 - bulky waste. Waste is in the form of "bulk" (not baled, not ground).
1. The place of collection by the Ordering Party of waste being the subject of the contract shall be:
- PSZOK at Stationary Street in Wałbrzych,
- PSZOK at 43 Beethoven Street in Walbrzych
2. Transport of waste in vehicles adapted for this purpose shall be carried out by transport owned by the Ordering Party and at its expense.
Management of waste code 170107 mixed waste of concrete, brick rubble, waste ceramics and equipment other than those mentioned in 17 01 06.1. The place of collection by the Ordering Party of waste being the subject of the contract shall be:
- PSZOK at Stationary Street in Wałbrzych,
- PSZOK at 43 Beethoven Street in Walbrzych
2. Transport of waste in vehicles adapted for this purpose shall be carried out by transport owned by the Ordering Party and at its expense. The vehicle at the disposal of the Ordering Party is a container transport kit (car + trailer).
3. The place of management of the waste in question is the installation indicated in the Contractor's offer, located at a distance of no more than 80 km – the distance calculated by the shortest route for vehicles
weighing more than 3.5 Mg from the PSZOK run by the Ordering Party at 43 Beethovena Street
in Wałbrzych.
4. The Contractor is obliged to take over the waste delivered by the Contracting entity for management on working days, from Monday to Friday, from 7:00 to 15:00. If it is not possible to accept waste for management through the installation indicated by the Contractor, the Contractor is obliged to inform by e-mail to the address indicated by the Contracting entity about the occurrence of such a situation immediately after its occurrence, as well as indicate another installation for the management of the above-mentioned waste in accordance with the provisions in the SWZ and the contract.
5. Weighing of waste delivered by the Contracting entity to the installation indicated by the Contractor shall take place on the Contractor's legalized scale located on the premises of the installation indicated by the Contractor as the place of management of the waste in question. The waste transferred for management will be weighed on a legalized truck scale, with an accuracy of 20 kg. To determine the weight of the transferred waste, the Ordering Party's vehicle must be weighed before unloading. The above weight will be binding for settlements between the parties.
6. Weighing shall be confirmed each time by a weight receipt.
7. Settlement for waste collection will take place on the basis of confirmed KPO in the BDO system for the month in which the service was performed, being the sum of the masses indicated in the weight receipts for the month in which the service was performed.
8. Unloading of waste transferred for management by the Ordering Party shall take place on the premises of the installation indicated by the Contractor, in a place indicated by an employee of this installation. The Contractor must provide the Contracting entity with the possibility of smooth/quick unloading of waste.
9. The estimated amounts of waste in individual parts of the contract that the Contracting Authority intends to transfer for management to the Contractor is:
- PART I - Approx. 1400 Mg during the term of the contract
10. The Ordering Party reserves the right to change the amount of waste. The amount of waste may be reduced by no more than 20% or increased, according to the needs of the Ordering Party. A change in the amount of waste results in a change in the final remuneration of the Contractor. Failure to perform the entire scope of the contract may not give rise to any claims on the part of the Contractor against the Contracting Entity.
11. Transport of waste shall be carried out by transport organized by the Ordering Party and at its expense, also in terms of transport costs, insurance for the time of transport and unloading.
12. The Contractor, who is also the final Purchaser for the management of the waste in question, or the Purchaser of the waste indicated by him, must be entered in the BDO (Waste Database) as part of their business. In accordance with the applicable regulations, the Contracting Authority issues a KPO (Waste Transfer Card) for each transferred batch of waste via BDO according to the data concerning the Waste Transferee indicated by the Contractor.
13. The Contractor shall be solely liable for any damage, as well as for loss, loss and damage to waste caused during storage, until they are subjected to and the management process is completed. The Contractor shall be liable, in particular, for the acts and omissions of its staff and entities used to perform the contract
