The subject of the contract is the service of planting trees in arteries in Łódź m.in on Inflancka Street, Sikorskiego Avenue, Rokicińska Street. A detailed description of the subject of the contract can be found in Annex 1 to the SWZ.

The subject of the contract is the service of planting trees in arteries in Łódź m.in on Inflancka Street, Sikorskiego Avenue, Rokicińska Street. Delivery and transport of trees. Transport is carried out by the Contractor on its own, without the participation of the Board of Urban Greenery, it must take place in a way that does not cause damage to trees. The Contractor is obliged to present all plant material before planting for acceptance by the Contracting Entity. In case of non-acceptance, the Contractor shall replace the defective material and resubmit it to the Ordering Party.

The contracting authority withdrew from dividing the contract for technical, organizational and economic reasons. Failure to divide the contract into lots will not violate the principle of fair competition and will not limit the possibility of applying for the contract for smaller entities. Contractors belonging to SMEs will have no difficulty in implementing it as a whole.

Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or Subcontractor, on the basis of an employment relationship, to employ persons performing activities specified in the Description of the Subject of the Contract, related to the performance of the contract, the performance of which contains the features of an employment relationship specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2020, item 1320, as amended), i.e.: tree planting service. The scope of work of persons performing the activities indicated by the Contracting Authority in the field of contract performance and the method of documenting the employment of these persons and the Ordering Party's rights to control the Contractor's compliance with the requirements and sanctions for non-compliance with them are specified in the description of the subject of the contract (Annex No. 1 to the SWZ) and in the contract template (Annex No. 6 to the SWZ).

The order must be completed within 5 months from the date of signing the contract, but not later than by 30 November 2023.

Pursuant to Article 139 (1) of the Pzp Act, the Contracting Authority will first examine and evaluate the tenders and then make the qualifications of the contractor whose offer has been highest assessed in the absence of grounds for exclusion and fulfilment of the conditions for participation in the proceedings.

(SWZ No.) 5. INFORMATION ON THE EVIDENCE IN QUESTION The Contracting Authority shall not require the Contractor to submit the said means of evidence.

24.1 The Contractor whose offer has been selected is obliged to lodge a performance bond in the amount of 5% of the total gross price specified in the offer. 24.2 The security is used to cover claims for non-performance or improper performance of the contract.
