The subject matter of this order is the COMPLEXICAL DELIVERY OF ELECTRIC ENERGY, OFFERING SALE AND ENERGY SERVICE OF THE ELECTRIC ENERGY DISTRIBUTION SERVICES FOR THE SULMIERSIS GMINE AND ONE ORGANISATION NOTES to the objects of the Ordering Party and the organizational units indicated in Annex 1 to SWZ, in accordance with the provisions of the Act of 10 April 1997, Energy Law. Order — purchase and distribution of electricity to the facilities listed in Annex 1 to SWZ: Estimated electricity demand for the period from 01.01.2022 to 31.12.2023 is 1,980 952,00 kWh. The Contracting Authority reserves the ability to reduce or increase the amount of electricity ordered. The operator of the Distribution System is PGE Distribution S.A.

The Municipality of Sulmierzyce and the units listed in Annex No 1 to the SWZ will conclude separate contracts resulting from this procedure for the award of a public contract by means of an unrestricted tender. Details of the conclusion of contracts are included in Annex No 1 to SWZ and Annex 5 to SWZ (paragraph 1 (10). The duty of the selected Contractor shall be to notify the designated Distribution System Operator for the implementation of the Comprehensive Electricity Supply Agreement concluded with the Contractor, including the sale and provision of electricity distribution services. The Contractor shall be granted an appropriate power of attorney (Annex No 5.1 to SWZ) to perform the above-mentioned activities.

The Contracting Authority shall act on his own behalf and on the basis of the signed Agreement (Agreement for inspection at the office of the Contracting Authority), on behalf of the organisational units which are indicated in Annex 1 to the SWZ:

For most of the collection points, Comprehensive Electricity Sales and Distribution Agreements are concluded with PGE Turnover S.A. for a fixed period until 31.12.2021. One point has a Comprehensive Agreement with PGE Turnover S.A. for an indefinite period with three months notice.
The supply of electricity and the provision of distribution services will be carried out under the conditions laid down፦ in the Act - Energy Law of 10 April 1997 (Journal of Laws of 2021, item 716), the implementing provisions of this Act, and in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions of the operation of the electricity system (Journal of Laws 2008 No. 162, item 1005 as amended), - Tariff for electricity distribution services of the relevant Distribution System Operator (TSO Tariff), - Traffic and Operation Instructions of the Distribution Network (IRiESD) and generally applicable legal rules. Electricity should meet technical parameters in accordance with the provisions of the Energy Law Act and the implementing regulations of this law and Polish Standards.
