The entire waste collection (door to door), its processing and operation of the municipal recycling park as well as everything related to waste prevention and awareness-raising is currently in the hands of the Inter-municipal environmental company East Brabant “Ecowerf” and this via management transfers. The management transfers end on 31.12.2021. The lease for the exploitation of the municipal recycling park ends on 31.12.2023 but can be terminated prematurely to also end on 31.12.2021.
Any renewal of the management transfer to Ecowerf must take place no later than 31.6.2021. However, the municipality of Glabbeek wishes to verify by means of the current procedure whether there are no more competitive players on the private market before deciding whether or not to extend the management transfer to Ecowerf for another 18 years.
The assignment consists of a fixed part and a conditional part.
The fixed part concerns:
- Door-to-Door collection (see III.2-fixed part),
- collection of glass: Glass balls (see III.3-fixed part)
- collection on demand by municipal services (see III.4-fixed part),
- specifically requested services under III.5 fixed part.
The conditional part concerns:
- recycling park (see III.6-conditional part).
A conditional part is included within the contract (exploitation of the recycling park). The client reserves the right to include or not include these conditional services in the effective implementation. For the exploitation of the recycling park, the client must work with a conditional part because the exploitation of the recycling park is complex (after all, the municipality must conclude contracts itself with, among others, Fostplus, Recupel, Bebat, Valumat, Valorlub and Valorfrit. and the conditions for this are not yet known.The municipality of Glabbeek is therefore considering leaving the exploitation of the recycling park with Ecowerf if it appears that concluding these agreements would not be possible and / or the offers to be submitted are not favorable to Glabbeek so that also for budgetary reasons it is not possible to order the conditional part.
Whether the client actually orders the conditional part will be made known to the chosen tenderer no later than three months after the award decision has been communicated to the chosen tenderer. After this date, the conditional part can no longer be ordered and the chosen tenderer is no longer bound by it.
The client is not obliged to award the assignment. The client expressly reserves the right to:
- either not to be allocated with regard to both the fixed and the conditional part (in particular, but certainly not exhaustively, if it appears that there is no significant price advantage for the client compared to the prices of ecowerf)
- or to restart the assignment if necessary in a different way, in both cases without an entrepreneur being able to claim any compensation
