1. The subject of the order is "Successive delivery of concrete materials for paving works and elements for road drainage for the needs of Przedsiębiorstwo Usług Komunalnych Sp. z o. o. in Tarnów in 2020. "

3. The order was divided into 4 lots, ie:
3.1. lot 1 of the contract - delivery of vibro-pressed concrete materials for paving;
3.2. lot 2 - delivery of prefabricated concrete drainage elements;
3.3. lot 3 - supply of plastic elements for drainage;
3.4. lot 4 - supply of iron elements for drainage.
1. The subject of this part of the order is the gradual delivery of vibro-pressed concrete materials for paving works, intended for the construction and repair of roads, pavements and parking lots in the city of Tarnów.
2. This part of the order includes the range specified in the ToR.
3. Requirements that must be met by the vibro-pressed concrete materials offered for paving:
1) vibro-pressed concrete materials for paving works (hereinafter referred to as "materials") may not come from demolition, must be brand new, of the first grade, free from defects, meet the parameters and technical and operational requirements set out in the Terms of Reference, as well as have appropriate approvals, certificates and approvals technical and manufacturer's declaration of performance confirming their compliance with applicable standards and physico-chemical properties;
2) materials must be placed on the market and used for road works to the extent relevant to their operational properties and purpose, in accordance with applicable law, including the Act of 7.7.1994 Construction Law (Journal of Laws of 2019, item 1186, as amended), the Act of 16.4.2004 on construction products (Journal of Laws of 2019, item 266, as amended) and other relevant provisions, including the Regulation of the Minister of the Environment on 27.10.2005 on the types and conditions of use of means that can be used on public roads, streets and squares (Journal of Laws of 2005 No. 230 item 1960), have the CE mark and meet the requirements of the following standards:
a) concrete cubes: PN-EN 1338: 2005 - concrete paving stones - requirements and test methods or equivalent,
b) curbs: PN – EN 1340: 2004 - concrete or equivalent curbs,
c) concrete flagstones: PN-EN 1339: 2005 - concrete flagstones or equivalent,
d) edges: PN – EN 1340: 2004 - concrete or equivalent curbs,
e) palisade: PN-EN 1340: 2004 - concrete or equivalent curbs;
3) under the term equivalence The Purchaser understands that the offered materials meet the requirements of the above standards in the scope of: compressive strength, density, frost resistance, water tightness. In accordance with art. 30 paragraph 5 of the Public Procurement Law, the Contractor who refers in the offer to equivalent solutions is obliged to demonstrate that the range offered by him meets the requirements of the abovementioned standards in range. The Contractor whose bid is the highest rated will be invited to submit to the Ordering Party on the form constituting Annex 6 to the ToR a declaration of compliance of the offered materials with the abovementioned standards or equivalent equivalence requirements;
4) materials will be delivered on returnable pallets (without paying a deposit). Pallets will be issued to the Employer on the basis of the Contractor's GM and returned to the Contractor by the Employer also on the basis of the Employer's GM within 150 days from the date of delivery of a given batch of material. In the absence of return by the Employer of the Contractor's pallets issued in the above deadline, the Contractor may - unless the parties decide otherwise - issue a VAT invoice to the Ordering Party for non-returned pallets, with the net value of PLN for the 1st pallet specified in the concluded contract, with a payment deadline of 60 days from the date of receipt of the invoice - payable by bank transfer.

2. This part of the order includes the range specified in the ToR.
3. Requirements that must be met by the prefabricated concrete elements offered for road drainage:
1) prefabricated concrete elements for road drainage (hereinafter referred to as "materials") may not come from demolition, must be brand new, of the first grade, free from defects, meet the technical and operational parameters and requirements specified in the Terms of Reference, and have appropriate approvals, certificates and approvals technical and manufacturer's declaration of performance confirming their compliance with applicable standards and physico-chemical properties;
2) materials must be placed on the market and used for road works to the extent relevant to their operational properties and purpose, in accordance with applicable law, including the Act of 7.7.1994 Construction Law (Journal of Laws of 2019, item 1186, as amended), the Act of 16.4.2004 on construction products (Journal of Laws of 2019, item 266, as amended) and other relevant provisions, including the Regulation of the Minister of the Environment on October 27, 2005 regarding the types and conditions of use of means that can be used on public roads, streets and squares (Journal of Laws of 2005 No. 230, item 1960), have a CE mark and meet the requirements of the PN-EN standard 1917: 2004 - manholes and manholes made of non-reinforced concrete, steel reinforced concrete and reinforced concrete or equivalent;
3) under the term equivalence The Purchaser understands that the offered materials meet the requirements of the said standard in the scope of: compressive strength, density, frost resistance, water tightness. In accordance with art. 30 paragraph 5 of the Public Procurement Law, the Contractor who refers in the offer to equivalent solutions is obliged to demonstrate that the range offered by him meets the requirements of the abovementioned standards in the abovementioned range. 1) plastic elements for drainage (hereinafter "materials") must not come from demolition, must be brand new, of the first grade, free from defects, meet the technical and operational parameters and requirements specified in the Terms of Reference, and have appropriate approvals, certificates and approvals technical and manufacturer's declaration of performance confirming their compliance with applicable standards and physico-chemical properties;
2) materials must be placed on the market and used for road works to the extent relevant to their operational properties and purpose, in accordance with applicable law, including the Act of 7.7.1994 Construction Law (Journal of Laws of 1186, as amended), the Act of 16.4.2004 on construction products (Journal of Laws of 2019, item 266, as amended) and other relevant provisions, including the Regulation of the Minister of the Environment on October 27, 2005 on the types and conditions of use of means that can be used on public roads, streets and squares (Journal of Laws of 2005 No. 230, item 1960), have a CE mark and meet the requirements of the PN-EN standard 1852-1: 2018-02 - plastic pipe systems for underground pressureless drainage and sewerage. 3) under the term equivalence, the Purchaser understands that the offered materials meet the requirements of the said standard in terms of: mass flow rate, thermal stability, resistance to internal pressure, tightness, material properties of sealing rings, impact resistance, elasticity or mechanical strength. In accordance with art. 30 paragraph 5 of the Public Procurement Law, the Contractor who refers in the offer to equivalent solutions is obliged to demonstrate that the range offered by him meets the requirements of the abovementioned standards in range. The Contractor whose bid is the highest rated will be invited to submit to the Employer on the form constituting Annex 6 to the ToR a declaration of compliance of the offered materials with the abovementioned standard or equivalent equivalence requirements.

2. This part of the order includes the range specified in the ToR.
3. Requirements that must be met by offered iron elements for drainage:
1) cast iron elements for drainage (hereinafter "materials") may not come from demolition, must be brand new, of the first grade, free from defects, meet the technical and operational parameters and requirements specified in the Terms of Reference, as well as have appropriate approvals, certificates and technical approvals, and a declaration of performance issued by the manufacturer confirming their compliance with the applicable standards and physico-chemical properties;
2) cast iron materials for drainage must be placed on the market and used for road works to the extent relevant to their operational properties and purpose, in accordance with applicable law, including the Act of 7.7.1994 Construction Law (Journal of Laws of 2019 item 1186), the Act of 16.4.2004 on construction products (Journal of Laws of 2019, item 266, as amended) and other relevant provisions, including the Regulation of the Minister of the Environment of 27.10 .2005 on the types and conditions of use of means that may be used on public roads, streets and squares (Journal of Laws of 2005 No. 230 item 1960), have the CE mark and meet the requirements of the standard: PN-EN 124- 2: 2015-07 tops of inlets and manholes for pavement for pedestrian and vehicular traffic - part 2: tops of inlets and manholes made of cast iron or equivalent;
3) under the concept of equivalence, the Employer understands that the offered cast iron elements for drainage meet the requirements of the said standard in terms of: appearance, load capacity, slip resistance, clearance, depth of grating, dimensions of grille gaps, water flow surface, determining the position of grates and covers, bearing surface body, body depth. In accordance with art. 30 paragraph 5 of the Public Procurement Law, the Contractor who refers in the offer to equivalent solutions is obliged to demonstrate that the range offered by him meets the requirements of the abovementioned standards in the abovementioned respect;
4) The Contractor whose bid is the highest rated will be invited to submit to the Employer on the form constituting Annex 6 to the ToR a declaration of compliance of the offered materials with the abovementioned standard or equivalent equivalence requirements.
