Purchase of electricity with a total volume of the basic order: 2 587 529 kWh and with a total volume resulting from the option right 430 666 kWh, which is the supply (sale) of electricity to the following collection points:

1) under part 1 of the contract with a volume for the basic order not exceeding 1 500 389 kWh – up to 157 collection (metering) points listed in the List of electricity collection points of the facilities of the Myszków Commune, which constitutes Annex 1 to the SWZ, and with a total volume resulting from the option right: 355 805 kWh;

2) under part 2 of the order with a volume for the basic order not exceeding 1 087 140 kWh – up to 20 collection (metering) points listed in the List of electricity collection points of the facilities of organizational units of the Myszków Commune, which constitutes Annex 2 to the SWZ, and

with a total volume resulting from the option right: 74 861 kWh.

1) The Contracting Authority, in the framework of the proceedings for the award of a public contract aimed at selecting an offer and concluding a contract for part 1 of the contract, acts on behalf of the Myszków Municipality and for the benefit of the Municipality of Myszków;

2) The estimated demand of electricity for the basic order in the period from 01.01.2024 to 30.06.2025 for 157 electricity collection points, specified in Annex 1 to the SWZ, is: 1 500 389 kWh, including:

a) in tariff group O11 – 1 304 127 kWh,

b) in tariff group C12B – 13 605 kWh, including:

• Day – 3 916 kWh,

• night – 9 689 kWh,

c) in tariff group C11 – 235 kWh,

d) in tariff group C21 – 182 368 kWh,

e) in tariff group R – 54 kWh;

3) The Contracting Authority has concluded indefinite contracts for the provision of electricity distribution services:

(a) from Tauron Distribution S.A., Branch in Częstochowa, Army Krajowa Al 5, 42-201 Częstochowa — in tariff groups: O11, C11, C21, R,

b) with Tauron Dystrybucja S.A., Branch in Będzin, Małobądzka 141, 42-500 Będzin – in tariff group C12B, and

c) a contract for the performance of reserve sale of electricity with TAURON Sprzedaż Sp. z o. o. with its registered office in Kraków.

4) The Contractor is obliged, on the basis of a power of attorney - Annex No. 11 to the SWZ, which will be granted by the Myszków Municipality, to notify the above-mentioned Distribution System Operators (DSOs) to implement a new electricity sale agreement for a customer connected to the distribution network of Tauron Dystrybucja S.A. and to carry out a procedure related to the change of electricity supplier;

5) The guaranteed, minimum scope of the contract in 2024, which will certainly be implemented, constituting the basic order, is: 1 016 470 kWh, including:

a) in tariff group O11 – 881 898 kWh,

b) in tariff group C12B – 9 246 kWh, including:

• Day – 2 684 kWh,

• night – 6 562 kWh,

c) in tariff group C11 – 138 kWh,

d) in tariff group C21 – 125 152 kWh,

(e) in tariff group R — 36 kWh;

6) The guaranteed, minimum scope of the contract in 2025, which will certainly be implemented, constituting the basic contract, is: 483 919 kWh, including:

a) in tariff group O11 – 422 229 kWh,

b) in tariff group C12B – 4 359 kWh, including:

• Day – 1 232 kWh,

• night – 3 127 kWh,

c) in tariff group C11 – 97 kWh,

d) in tariff group C21 – 57 216 kWh,

e) in tariff group R – 18 kWh

1) The Contracting Authority, in the framework of the proceedings for the award of a public contract aimed at selecting an offer and concluding a contract for Part 2 of the contract, acts on behalf of and for the benefit of the following organisational units of the Municipality of

(a) Adam Mickiewicz Primary School No. 1, 42-300 Myszków, Leśna Street 1,

b) John Paul II Primary School No. 2, 42-300 Myszków, 34 Jaworznicka Street,

c) Tadeusz Kościuszko Primary School with Integration Classes No. 3, 42-300 Myszków, 30 Kościuszki Street,

d) Elementary School with Integrative Branches No. 5 named after Henryk Sienkiewicz, 42-300 Myszków, Sikorskiego Street 20a,

e) Primary School No. 6, 42-300 Myszków, Wapienna Street 2,

f) Jan Brzechwa Primary School No. 7, 42-300 Myszków, Pińczycka Street 2,

g) Kindergarten No. 1 “FAIRYTALE”, 42-300 Myszków, 32 Sucharskiego Street,

h) Kindergarten No. 2, 42-300 Myszków, Pułaskiego Street 7A,

i) Kindergarten No. 3 with Integration Classes, 42-300 Myszków, 19 Millenium Street,

j) Kindergarten No. 4, 42-300 Myszków, 7 Skłodowska Street,

k) Maria Konopnicka Kindergarten No. 5, 42-300 Myszków, 1 Stalowa Street,

l) Municipal Sports and Recreation Centre, 42-300 Myszków, 3 Miedziana Street,

m) Municipal House of Culture, 42-300 Myszków, 3-go Maja 15 Street;

2) The estimated demand of electricity for the basic order in the period from 01.01.2024 to 30.06.2025 for 20 collection points, specified in Annex 2 to the SWZ, is: 1 087 140 kWh, including:

a) in tariff group C11 – 401 242 kWh,

b) in tariff group C21 – 271 084 kWh,

c) in tariff group C22B – 409 169 kWh, including:

• Day – 279 510 kWh,

• Night – 129 659 kWh,

d) in tariff group C12A – 5 645 kWh, including:

• peak zone – 1 779 kWh,

• off-peak – 3 866 kWh.

3) The above-mentioned organizational units of the Myszków Commune have concluded for an indefinite period of time agreements for the provision of electricity distribution services with Tauron Dystrybucja S.A. Branch in Częstochowa and concluded agreements with the reserve seller of electricity.

4) The Contractor is obliged on the basis of a power of attorney – Annex 13 to the SWZ, which will be granted by the municipality of Myszków to notify the Distribution System Operator (DSO): Tauron Dystrybucja S.A., Branch in Częstochowa to perform the concluded new contract for the sale of electricity for customers connected to the distribution network of Tauron Dystrybucja S.A., and to carry out the procedure related to the change of electricity supplier;

5) The guaranteed, minimum scope of the contract in 2024, which will certainly be implemented, constituting the basic order, is: 734 874 kWh, including:

a) in tariff group C11 – 274 513 kWh,

b) in tariff group C21 – 182 342 kWh,

c) in tariff group C22B – 274 541 kWh, including:

• day – 187 890 kWh,

• night – 86 651 kWh,

d) in tariff group C12A – 3 478 kWh, including:

• peak zone – 1 165 kWh,

• off-peak – 2 313 kWh

6) The guaranteed, minimum scope of the contract in 2025, which will certainly be completed, constituting the basic order, is: 352 266 kWh, including:

a) in tariff group C11 – 126 729 kWh,

b) in tariff group C21 – 88 742 kWh,

c) in tariff group C22B – 134 628 kWh, including:

• day – 91 620 kWh,

• night – 43 008 kWh,

d) in tariff group C12A – 2 167 kWh, including:

• peak zone – 614 kWh,

• off-peak – 1 553 kWh
