The subject of the contract are construction works consisting in the modernization of municipal roads and the replacement of water supply networks, i.e.:
1) Modernization of Jagodowa Street in Zielona Góra,
2) Replacement of the water supply system with connections along Jagodowa Street, Jędrzychowska Street and Konopna Street in Zielona Góra,
3) Modernisation of Nowojędrzychowska Street (km 0+604.75 to km 1+606.39), Kąpielowa Street and Zawisza Czarny Street in Zielona Góra - basic scope,
4) Replacement of the water supply system with connections along Kąpielowa, Jędrzychowska, Nowojędrzychowska, Mokra, Szmaragdowa Streets in Zielona Góra,
5) Modernization of Mieczykowa Street in Zielona Góra,
6) Modernization of Żytnia Street in Zielona Góra,
7) Modernization of Zawadzkiego-Zośki and Ptasia Streets in Zielona Góra,
8) Modernization of Mokre Street in Zielona Góra,
9) Modernisation of Nowojędrzychowska Street (from km 0+00.00 to km 0+604.75) – covered by the right of the option referred to in section 3.6 of the SWZ.
1. The subject of the contract are construction works consisting in the modernization of municipal roads and the replacement of water supply networks, i.e.:

2) Replacement of the water supply system with connections along Jagodowa Street, Jędrzychowska Street and Konopna Street in Zielona Góra,
3) Modernisation of Nowojędrzychowska Street (km 0+604.75 to km 1+606.39), Kąpielowa Street and Zawisza Czarny Street in Zielona Góra - basic scope,
4) Replacement of the water supply system with connections along Kąpielowa, Jędrzychowska, Nowojędrzychowska, Mokra, Szmaragdowa Streets in Zielona Góra,
5) Modernization of Mieczykowa Street in Zielona Góra,
6) Modernization of Żytnia Street in Zielona Góra,
7) Modernization of Zawadzkiego-Zośki and Ptasia Streets in Zielona Góra,
8) Modernization of Mokre Street in Zielona Góra,
9) Modernisation of Nowojędrzychowska Street (from km 0+00.00 to km 0+604.75) – covered by the right of the option referred to in section 3.6 of the SWZ.
2. A detailed description of the subject matter of the contract is included in Appendix I.2 to the Terms of Reference and
referred to in paragraphs 3.4 and 3.5 of the Terms of Reference.
3. The subject of the contract should be performed in accordance with the design documentation and the Technical Specifications for the Execution and Acceptance of Works included in Appendix I.5 to the Terms of Reference.
4. The detailed scope of works referred to in clauses 3.2.1),3),5)-9) of the Terms of Use is specified in the cost estimates (basic and optional scope) included in Appendix I.4 to the Terms of Reference, which should be submitted together with the offer in accordance with section 6.1.6) of the Terms of Reference.
5. The Contracting Authority informs that in this contract, in accordance with Article 441(1) of the Public Procurement Act, it provides for the exercise of the right of option. The type, maximum value and circumstances of exercising the option are specified in the documents referred to in sections 3.3-3.5 of the Terms of Use and the model agreement constituting Appendix I.3 to the Terms of Reference.
6. The Contracting Authority informs that for the scopes specified in clauses 3.2.1),3),5)-9) of the Terms of Use (basic and optional scope) the cost estimate (measurement) remuneration was adopted on the basis of the offer cost estimates included in Appendix I.4 to the Terms of Reference, and for the scopes specified in points 3.2.2) and 4) of the Terms of Use (basic scope) – a lump sum remuneration.
7. Appendix I.5 to the Terms of Use also contains bills of quantities for the scopes of works specified in points 3.2.2) and 4) of the Terms of Reference (lump sum fee). The Contracting Authority informs that the above-mentioned bill of quantities is only an auxiliary document - the quantities given in the bill of quantities are not the basis for the valuation of the subject of the contract for the Contractor, but are only intended to determine the technology of execution of works. In order to make a full valuation of the works, each of the Contractors is obliged to read the design documentation, STWiOR and the provisions of this Terms of Reference before submitting an offer.
8. The Contractor shall provide a warranty for the works covered by the contract for a period of min. 36 months and warranty for defects in works for a period exceeding the warranty by 6 months.
