The contract concerns a framework agreement for the supply of cabazitaxel IV for all hospitals of hospital network Ghent (UZ Gent - AZ Sint-Lucas & Volkskliniek Gent - AZ Jan Palfijn Gent and AZ Oudenaarde, cf. annex D).
The possible delivery points are:
1. AZ Oudenaarde, pharmacy, Minderbroedersstraat 3, 9700 Oudenaarde
2. UZ Gent, pharmacy, C. Heymanslaan 10, 9000 Ghent
3. AZ Sint Lucas & folk clinic, pharmacy, Groene briel 1, 9000 Ghent
4. AZ Jan Palfijn, Watersportlaan 5, 9000 Ghent
AZ Oudenaarde is only active in the award phase and takes care of, among other things, the administrative processing and organization during the publication of the contract, the evaluation of the nominations and of the tenders and the final award of the contract.
During the award procedure, AZ Oudenaarde is the only spokesperson for the participating institutions and the single point of contact for the candidates and/or tenderers.
However, as soon as the contract is awarded, a contractual relationship is established between the contractor and the participating institutions. This means that, after the award of the contract, the participating institutions each individually conclude a contract for their part with the tenderer to whom the contract was awarded, taking into account the applicable rules on public procurement and the conditions laid down in the contract documents.
Each of them is responsible for the execution of the agreement that they conclude with the chosen tenderer. The participating institutions are directly responsible for monitoring the execution of the assignment. Payment of the fee for the contract will be borne exclusively by the participating institutions. This also means that the participating institutions guarantee (non-exhaustive):
- price revisions and payments
- follow-up of the execution of the order and orders placed and the handling of all possible problems during the execution;
- inspections and acceptances:
- the application of ex officio measures, changes to the initial contract and additional services.
Az Oudenaarde no longer has any task or responsibility after the award and can therefore in no way be held liable by the contractor, supplier or service provider for either late payments or any other contractual shortcoming committed by one of the participating institutions themselves if these are related to the technical specifications, implementation conditions of the specifications.
The quantities shown in the inventory shall be the total probable quantities over a period of 2 years for all the hospitals listed in Annex D. These quantities are indicative (based on the average real decreases over the calendar year 2022). They do not bind the ordering authorities in any way. The supplier cannot claim compensation if these quantities are unlikely to be reached.
These quantities will be purchased via separate orders.
Duration: This assignment has a duration of 2 years, twice tacitly renewable for 1 year each.
