In the event of a tie, the decision will be made by drawing lots. The individual retrieval is based on the criteria of § 21 VgV. The fee to which the framework contract partners are entitled for the performance of their services is based on the fee tables of the HOAI or as a time fee on the basis of the framework agreement. If the individual call-off requires activities whose parameters are not regulated in the contract for the framework agreement, BIM GmbH will either specify these parameters on a mandatory basis or determine them as part of the new award procedure to be carried out. In doing so, the Client will first inquire all contractual partners in category C, stating the essential order parameters, whether there is a fundamental interest in the execution of the order. These contracting parties receive an invitation to submit a tender in order to participate in an award procedure to obtain the object-specific contract. If more than 5 contracting parties express their interest in the contract, the 5 contracting parties to be invited to submit an offer will be determined by lottery. If, despite a previous expression of interest, the Contractor fails to submit a tender in due time twice in succession, the contractual partner concerned shall be blocked from the next two queries for the expression of interest for the award of contracts in category C. After that, the imposed ban will be lifted and expressions of interest and bidding will be possible again. The invitations to submit tenders, non-submission of bids after expression of interest and the duration of the ban are documented by the client.
