Framework agreement for planning services for technical equipment

BIM Berliner Immobilienmanagement GmbH manages a wide range of assets on behalf of the State of Berlin. The contracting authority shall endeavour to award a framework agreement on planning services for technical equipment.

Provision of basic services, in accordance with service phases 1-9 of HOAI 2021 Part 4 Section 2 on the timesheet or on the basis of the chargeable costs. As a rule, this is effort-oriented within the framework of immediate measures for the short-term preparation of properties and objects and, if necessary, the involvement of specialist planners. In addition, for the transfer of these properties into an approved condition if necessary.

Assignments with an estimated net fee of up to €5,000 (category 0)

BIM GmbH manages the municipal properties of the State of Berlin as well as other properties of the public clients mentioned in Section I.1). In the course of this administration, there is a regular need for procurement with regard to a wide range of technical equipment services in accordance with § 55 HOAI. In order to cover the needs arising on the specified contract period, BIM will conclude a framework agreement with suitable companies. In order to give small and medium-sized enterprises in particular the opportunity to participate, the procurement requirements will be divided into four lots. BIM GmbH will determine the framework contract partners on the basis of their suitability. If there are more suitable bidders for one or more lots than the maximum number of planned framework contract partners, they will be evaluated according to the "Evaluation smartrix Technical Equipment" (see application documents) and included according to the ranking of the number of points achieved until the maximum number of planned framework contract partners is reached. In the event of a tie, the decision will be made by drawing lots. The individual retrieval is based on the criteria of § 21 VgV. The details are regulated in the contract for the framework agreement, which is part of the tender documents. The fee to which the framework contract partners are entitled for the performance of their services is based on the fee tables of the HOAI or as a time fee on the basis of the framework agreement. BIM GmbH sets the hourly rates in a binding manner. Competition is therefore exclusively based on non-price criteria. If the individual call-off requires activities whose parameters are not regulated in the contract for the framework agreement, BIM GmbH will either specify these parameters on a mandatory basis or determine them as part of the new award procedure to be carried out. Orders with a projected net fee of over €5,000 up to and including €20,000 (category A)

In order to cover the needs arising on the specified contract period, BIM will conclude a framework agreement with suitable companies. The individual call in category C is carried out as part of the implementation of a separate award procedure. In doing so, the Client will first inquire all contractual partners in category C, stating the essential order parameters, whether there is a fundamental interest in the execution of the order. If 5 or fewer contracting parties express their interest in the contract, a separate procurement procedure shall be carried out with these contracting parties. These contracting parties receive an invitation to submit a tender in order to participate in an award procedure to obtain the object-specific contract. If more than 5 contracting parties express their interest in the contract, the 5 contracting parties to be invited to submit an offer will be determined by lottery. If, despite a previous expression of interest, the Contractor fails to submit a tender in due time twice in succession, the contractual partner concerned shall be blocked from the next two queries for the expression of interest for the award of contracts in category C. After that, the imposed ban will be lifted and expressions of interest and bidding will be possible again. The invitations to submit tenders, non-submission of bids after expression of interest and the duration of the ban are documented by the client.
