The subject of the contract are construction works consisting in the performance of the task: "Rebuilding of a small retention tank in the forestry of Małomice" (13-14-1.1-01).
The task will be implemented by restoring existing small retention facilities. The detailed scope of the contract is specified in the project documentation, which consists of:
1. Construction project and detailed design
2. Technical specification of the execution and acceptance of the works
3. Bill of quantities
The project involves the reconstruction of the existing retention tank currently in unsatisfactory condition, making it impossible to perform the functions for which it is intended. The project does not change the purpose of the area where it is implemented or
On which it affects. The reservoir in question is located within the town of Czerniec, at
Forest lands managed by the Lubin Forest District, in Małomice Forestry. The villages of Czerniec from the north and Niemstów from the south are close -
Only 1 km away. Currently, the canopy of the tank is largely silted, overgrown with vegetation (reeds), it is currently not filled with water due to inefficient and partly damaged damming devices. The existing reservoir and the Młyniec canal at which it was built are German buildings. The investor does not have technical documentation of the tank that would allow to clearly define its original parameters and purpose. The project consists mainly of replacement works, the necessity of which is carried out mainly due to the passage of time. At the same time, the function of the reservoir, which is to be retention, is determined at the same time.
The task should be performed in accordance with: a) in accordance with applicable law, i.e.: a.1) the Act of 7 July 1994 Construction Law (consolidated text: Journal of Laws of 2018, item 1202, as amended); a.2) by the Act of 23 April 1964, the Civil Code (consolidated text: Journal of Laws of 2018, item 1025, as amended); a.3) by the Act of 29 January 2004, the Procurement Law public (consolidated text: Journal of Laws of 2018, item 1986, as amended); a.4) by the Act of July 20, 2017 on Water Law (consolidated text: Journal of Laws of 2018 item 2268, as amended); a.5) by the Act of 27 April 2001 - Environmental Protection Law (consolidated text: Journal of Laws of 2018, item 799, as amended); a. 6) the Act of April 16, 2004 on nature protection (consolidated text: Journal of Laws of 2018, item 1614, as amended) a.7) by the Regulation of the Minister of the Environment of November 18, 2016 on on hydrogeological documentation and geological and engineering documentation (Journal of Laws of 2016, item 2033, as amended); a.8) Act of 14 December 2012 on waste (consolidated text: Journal of Laws of 2018, item 992, as amended as amended); a.9) by the ordinance of the Minister of the Environment of December 12, 2014 regarding the template of documents used for the needs of waste records (Journal of Laws of 2014, item 1973, as amended), a.10) Regulation of the Minister of the Environment of December 29, 2014 regarding the waste catalog (Journal of Laws of 2014, item 1923, as amended). b) based on the project implementation manual, including guidelines for the implementation of tasks and small retention facilities and water erosion prevention, Annex 12 to the ToR, c) Communication of the Minister of Development of 7.01.2016 regarding the guidelines of the Minister of Infrastructure and Development regarding documentation of proceedings on environmental impact assessment for projects co-financed from national or regional operational programs (i.e. MP of 2016 item 54). A detailed description of the subject of the contract has been described in chapter 3 of the ToR.
1. The proceedings are conducted in accordance with the rules provided for "Reverse procedure" referred to in Article 24aa section 1 and 2 Pzp. Pursuant to the aforementioned provisions, the Employer will first evaluate the offer and then examine whether the contractor whose offer has been assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure.
The contracting authority requires employment by a contractor or subcontractor on the basis of an employment contract of persons performing activities included in the subject of the contract specified in point 3.5 of the ToR, if the performance of these activities involves performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974. .- Labor Code (consolidated text: Journal of Laws of 2018, item 917, as amended).
3. The contractor may entrust the implementation of elements (parts) of the contract to subcontractors in accordance with the contract and the ToR.
