1..The subject of this contract is the supply of electricity to the Municipality of Świdnik and its organizational units for the needs of street lighting and the operation of buildings and premises. 2.A list of collection points together with relevant information on the conditions under which electricity sales services are currently provided and detailed demand for electricity is attached as Annex 7 to the SWZ – "Detailed description of the subject of the contract" 3.The Contractor is obliged to provide the Ordering Party / final customer with quality standards of service in accordance with the applicable provisions of the Energy Law, in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the functioning of the power system (Journal of Laws No. 93z2007, item 623, as amended) 4. The supply of energy will take place on the basis of contracts concluded separately by individual End Users, the list of which is included in Annex No. 5 to the SWZ.

1.The subject of this contract is the supply of electricity to the Municipality of Świdnik and its organizational units for the needs of street lighting and the operation of buildings and premises.2.The list of collection points together with relevant information on the conditions under which electricity sales services and detailed demand for electricity are currently provided is Attached Note 7 to the SWZ – "Detailed description of the subject of the contract"3.The obligated contractor is to provide the Ordering Party/end user with quality standards of service in accordance with the applicable provisions of the Energy Law, in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the functioning of the power system (Dz.U. No. 93 of 2007, item 623 of late. 4.The supply of energy will take place on the basis of contracts concluded separately by individual End Users, the list of which is included in Annex 5 to the SWZ – "List of End Users" 5.The estimated amount of energy supplied during the delivery period is 5 938 206 kWh, including: the Ordering Party declares that the forecast of energy consumption indicated above and in Annex 7 to the SWZ – a detailed description of the subject of the contract is only an approximate value, which in the course of performance of the Agreement may be increased or decreased in relation to the forecasts for individual Recipients. The actual energy consumption (less or greater than the energy consumption forecast indicated in Annex 7 to the SWZ) will depend only on the actual needs of individual End Users, except that regardless of the volume of consumption, the Contractor is obliged to apply the energy prices offered in the tender in each case. The Contractor may not assert any financial claims from the Ordering Party or the Final Customers (e.g. compensation) if, during the term of the contract, the Ordering Party or individual End Customers purchase from the Seller a smaller or larger amount of electricity than the forecast amount of energy indicated in Appendix No. 7 to the SWZ, in particular caused by an increase or decrease in the number of Energy Consumption Points (PPE) for individual Customers, change of tariff group, change of ordered power or technical parameters of PPE. 6.Additional information:The purpose of this joint procurement is to harmonise rates and simplify the rules for accounting for active electricity consumption. The Contracting Authority intends to achieve the above in particular by obtaining one, fixed price per kilowatt hour, appropriate for individual tariff groups, therefore the offered unit price of electricity must include all additional costs and fees related to the implementation of the subject of the contract, including in particular those resulting from commercial balancing or fixed costs of commercial fees. Electricity should meet technical standards in accordance with the provisions of the Energy Law and the implementing regulations to this Act and Polish Standards. In the event of failure to meet the quality standards of service, the Ordering Party, at its written request, has the right to a discount at the rates specified in the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for shaping and calculating tariffs and settlements in electricity trading (Journal of Laws of 2019, item 503) or in any subsequently issued legal act specifying these rates. The description of the subject of the contract can be found in Annex 7 to SWZ - Detailed description of the subject of the contract. Remark!!! For the performance of the subject of the contract in accordance with point 4 with the Contractor selected in the tender, separate contracts will be signed by organizational units of the Świdnik Municipality in accordance with Appendix No. 5 to SWZ – List of end users. In addition, each organizational unit will cover the costs of energy supply. The agreement will be concluded according to the template constituting Annex No. 1 and 1A to the SWZ.
