1. The subject of the contract is: successive delivery of orthopedic implants to SP ZOZ Siemiatycze, in quantities and assortment specified in the assortment and quantity and price form, application to successive reported needs (orders) of the Ordering Party, packages from 1 to 7 of the Terms of Reference, described in detail in Annex 2, constituting an integral part of it, and then an integral part of the supply agreement constituting Annex 1 to the contract. 2. A detailed description of the subject of the contract, a list of the required boundary parameters covered by the delivery listed in paragraph 1 shall be included in the quantitative form together with a description, constitutes Annex 2 to the Terms of Reference in detail to the offer, constituting an integral part of it, and then an integral part of the supply agreement. 3. The Contractor shall be obliged to perform the contract on the terms and conditions described in the model delivery agreement constituting Annex 3 to the SWZ. 4. The quantity of the Goods specified in the SWZ, to be purchased during the term of the Agreement, has been determined in an estimated manner. The quantity of Goods purchased by the Ordering Party during the term of the Agreement may be lower or increase and in this respect the Contractor is not entitled to any claims against the Ordering Party, provided that the Ordering Party acquires Goods with a value not lower than 40% 5. The contracting authority requires that the assortment offered in this public procurement procedure, within the scope of the submitted bid, meets the conditions and has the necessary markings, certificates, declarations of conformity placing on the market and use in the territory of a Member State, referred to in the Act of 20 May 2010 on medical devices (Journal of Laws of 2021, item 1565, as amended) 6. The validity period of the delivered Goods may not be shorter than 12 months from the date of receipt of the delivery of the Goods, deliveries of products with a shorter validity period may be allowed in exceptional situations, each time the consent must be expressed by an authorized representative of the Ordering Party.
