Open procedure, pursuant to art. 3, lett. sss), art. 60 and art. 122 of Legislative Decree no. 50/2016, for the assignment of the electronic ticketing software maintenance service: central system and peripheral subsystem of ATAC SpA, lasting thirty-six months, to be experimented through the e-procurement system.

The contract concerns the maintenance of ATAC's electronic ticketing system (SBE) software. For details of the activities covered by the contract, please refer to the special specifications and related annexes.

The maximum estimated total value of the contract is EUR 3 000 000.00 plus statutory VAT, made up as follows:

(a) amount for corrective maintenance and operational support activities EUR 1 500 000.00;

b) amount for evolutionary maintenance activities EUR 1 500 000.00;

c) security charges 0,00 EUR.

Since these are services of an intellectual nature, the contracted activities are not considered subject to the obligation pursuant to art. 23, paragraph 16 of Legislative Decree no. 50/2016, as amended by art. 13 of Legislative Decree no. 56/2017, relating to the indication of the cost of labor.

The contract will be awarded with the criterion of the most economically advantageous offer, as required by current legislation pursuant to art. 95, paragraph 3, lett. b) of Legislative Decree no. 50/2016, attributing a maximum score of 70 points to the technical offer and 30 points to the economic offer, as detailed in art. 11 of the special conditions. The awarding of the tender may also take place in the presence of a single offer provided that ATAC deems it valid, convenient, congruous or suitable.

The offers may be subject to judgment of anomaly / fairness of the price. Only competitors who have achieved a score of at least 35 points in the technical evaluation will be admitted to the examination of the economic offers.

The contract will have a duration of 36 months from the delivery of the service as provided for in art. 7 of the special conditions.

The contractual relationship may have a shorter duration should the forfeiture, revocation or modification of the in-house assignment to ATAC occur, as required by municipal resolution no. 273 of 6.8.2015, without the recognition of any amount, also by way of compensation, in favor of the contracted operators.
