The object of the contract is support and consulting services for the implementation of IT emergency management, including the development of an IT emergency manual and corresponding emergency processes for the hospitals of Sana Kliniken AG as call-off clients (Annex 3).
The aim of the award procedure is to conclude a framework agreement with a company (§ 21 para. 3 VgV) for a certain quota of man-days to support IT emergency management projects in the clinics entitled to call them.
The framework agreement is a contract concluded for the term specified in the notice which obliges the contractor(s) to perform the services called up with individual contracts under the conditions laid down in the framework agreement and the respective individual contract.
These specific contracts shall be awarded exclusively by the contracting entities listed in Annex 3 "List of contracting entities" to the undertaking which is at that time a party to the framework agreement.
The clients entitled to call off the required services via individual orders in accordance with the terms of the framework agreement.
The estimated expenditure can be found in Annex 4 to the contract. The total order volume of all individual orders arising during the term is therefore not bindingly determined. There is no obligation to accept.
When the contract is awarded, the framework agreement is concluded for all clients entitled to call them off. The individual call-offs, on the other hand, are made separately for each client entitled to call.
The clients entitled to call (Annex 3) are recipients of subsidies from the Hospital Future Act, including the Hospital Future Fund, and are obliged to comply with procurement law by the funding decision. Some contracting authorities are bound by (antitrust) procurement law as contracting authorities within the meaning of the GWB.
