The subject of the contract is the delivery and assembly of an apparatus for electrophysiological tests with software and instrumentation, as well as the design and execution of construction works necessary, in accordance with the hardware requirements of the Device, for its proper assembly, acceptance and subsequent operation, along with the reconstruction of part of the Ambulatory Rehabilitation Center in the Hospital Facility located in Wrocław at Gen. Augusta Emila Fieldorfa 2 Street.

The material scope of the contract includes in particular:

1) adaptation of the rooms indicated by the Ordering Party to the operation of the Apparatus.

a) As part of the performance of the subject of the contract, the Contractor should design and perform works consisting in adapting to the operation of the Apparatus the rooms indicated by the Substitute Investor in the PFU constituting Annex 11 to the SWZ and the Guidelines of the Contracting Authority constituting Annex 11a to the SWZ. For design purposes, the Substitute Investor provides a fragment of as-built documentation of the Facility in the scope covering the investment area, in the following industries:

architecture

technological heat (CT),

medical gases,

access control (AC),

telecommunication installations (LAN),

ventilation

ice water (LC),

wod kan.

The drawings are attached as Annex 11b to the SWZ.

(b) Adaptation of the premises shall be carried out in accordance with:

provisions included in the draft provisions of the agreement – constituting Annex 9 to the SWZ,

PFU and STWiOR constituting Annex 10 to the SWZ,

the Ordering Party's guidelines constituting Annex 11a to the SWZ,

2) delivery, assembly of the Camera and its commissioning.

a) REQUIREMENTS of the Substitute Investor regarding the offered supplies:

The Substitute Investor requires that the offered Camera:

• was brand new (year of manufacture 2023),

• was unused, was not the subject of exhibitions or presentations, was not reconditioned equipment, has not been previously used by another user - this also applies to all components of the Camera, equipment, etc.,

• was complete and to be commissioned and used in accordance with

for the purpose of which it will not be necessary to purchase additional elements

and accessories,

• was admitted to the market and use in the Republic of Poland in accordance with applicable law, in particular the Act of 07.04.2022 on medical devices (Journal of Laws of 2022, item 974),

• was characterized by all technical and functional parameters required by the Substitute Investor indicated in Annex 3 to the SWZ,

• was devoid of service blockades, which after the warranty would hinder the Ordering Party access to service options or repair of the Camera by an entity other than the Contractor, if the Ordering Party does not use the Contractor's post-warranty service.

The Contractor will be obliged to provide a guarantee for the delivered Camera and provide its service during the warranty period – on terms consistent with the requirements of the Contracting Authority specified in the draft provisions of the contract – constituting Annex 9 to the SWZ.
