1. The subject of the contract is property insurance, civil liability insurance and motor insurance of the Units of the Lubelskie Voivodeship.
The order is divided into 2 parts and includes an insurance service:
Part 1 Business and property liability insurance:
a) Property insurance against all risks (all risks), including insurance of electronic equipment,
b) Business liability insurance.
Part 2 Motor insurance:
a) Insurance of civil liability of motor vehicle owners for damage caused by the use of these vehicles and civil liability insurance of owners of motor vehicles in foreign traffic ZK (OC / ZK),
b) Accident insurance for drivers and passengers (NNW),
c) Auto-casco insurance (AC) with the risk of theft (KR),
d) Assistance Assistance Insurance (ASS).
Insurance of property and civil liability on account of business activity and owned property1. Part 1 Business and property liability insurance:
a) Property insurance against all risks (all risks), including insurance of electronic equipment,
b) Business liability insurance.
2. In matters not regulated in the Agreement, the General Terms and Conditions of Insurance (hereinafter: GTC) of the Contractor shall apply, which shall constitute an appendix to the Agreement. In the event of a contradiction between the provisions of the Agreement and the SWZ and the provisions of the General Terms and Conditions of Insurance referred to in paragraph 3, the provisions of the Agreement and the SWZ shall apply.
3. A detailed description of the subject of the contract and a detailed manner of performance of the contract shall be included in the annexes to this specification:
1) Annex 1 to the SWZ – Description of the subject of the contract
2) Annex 1a to the SWZ – Rules for loss adjustment
3) Annex 1b to SWZ - List of property
4) Annex 1d to the SWZ - Damage
5) Appendix 2a to the SWZ - Draft provisions of the agreement
4. The Contracting Authority provides for the award of contracts referred to in Article 214(1)(7) of the Public Procurement Law. The Contracting Authority provides for the possibility of awarding, within three years from the date of award of the basic contract, a contract consisting in the repetition of services similar to the basic contract constituting up to 15% of the basic contract, to the existing Contractor in the event of the need to insure the Ordering Party's property (e.g. newly acquired). The award of the contract will be preceded by conducting a single-source procurement procedure, after negotiations with the Contractor. The method of settlement with the Contractor is described in the draft provisions of the contract.
5. Before signing the contract, the Contractor whose offer will be selected as the most advantageous will be obliged to submit the content of insurance policies for acceptance by the Contracting Authority and the broker of the Ordering Party, as well as the GTC.
6. After the Contracting Authority has conducted the procurement procedure and selected the most advantageous offer, the entity for which the procedure was conducted shall independently and on its own behalf sign a contract with the Contractor selected in the proceedings in a given part, within the deadline resulting from the Public Procurement Law. The entity for which the proceedings were conducted is obliged to inform the Ordering Party (LCIT) about the date of conclusion of the contract.
7. In the scope of Part 1 of the proceedings, the Contractor shall attach to the offer (in electronic form bearing a qualified electronic signature) the Price Form for Part 1 - in accordance with Appendix No. 3a to the SWZ. However, this document must be supplemented.
8. The Contracting Authority specifies in the SWZ and Essential provisions of the contract the requirements regarding the obligation to apply the Act on electromobility and alternative fuels.
Motor insurance1. Part 2 Motor insurance:
a) Insurance of civil liability of motor vehicle owners for damage caused by the use of these vehicles and civil liability insurance of owners of motor vehicles in foreign traffic ZK (OC / ZK),
