The subject of the order is to receive municipal waste generated in the territory of the municipality of Wilkowice, and originating:

- from the owners of the property where the inhabitants reside,

- from owners of property where residents do not reside and there are cottages or other properties used for recreational and leisure purposes on which waste is created, as referred to in Resolution XII/103/2019 of the Wilkowice Municipality Council of 30 October 2019.

On the date of signing the contract, the contractor will receive a detailed list of the property/address points from which municipal waste will be collected. During the implementation of the contract, the lists will be updated on a regular basis.

The planned quantities of Mg units during the period of implementation of the contract and the minimum and maximum quantities of waste received during the period of implementation of the contract are set out in Annex 1 to SWZ.

1. The Contractor shall be obliged to receive municipal waste:

(a) continuously, not interfering with night rest (from 7.00 to 20.00),

(b) within the dates resulting from the accepted reception schedule,

(c) irrespective of weather conditions,

(d) vehicles adapted to receive individual fractions of waste, excluding mixing of waste selectively collected different types together and selectively collected municipal waste with mixed municipal waste,

(e) irrespective of narrow and unpaved and obstructed access to the property, and

from the property accessed by road with a limited vehicle weight of up to 3.5 tonnes,

f) where the intervention notified by the resident, which is submitted by the Contractor, is unfounded (e.g. the container/bag was not issued by the resident) on the day of receipt, the Contractor is obliged to make a handwritten note on the absence of the waste issued (bag/ container) and document it with a photo (photographic documentation should be with the date and time, allowing to find out the absence of waste), and then forward this information to the Ordering Party, which will form the basis for receiving the waste at the next date according to

with a schedule for a particular area.

(g) in the event of non-compliance of segregation, the Contractor shall be obliged to carry out documentation enabling the procedure to issue an administrative decision amending the municipal waste management fee using the increased fee rate (documentation photographic with a date allowing for the assignment of containers or bags to a particular property and a written statement from the Contractor's employee, who found the non-compliance of segregation confirmed by a readable signature).

2. The Contractor is obliged to receive all municipal waste specified

in Table 1:

- collected in containers and/or bags meeting the minimum requirements laid down in the Regulations of maintenance of cleanliness and order in the territory of the Wilkowice Municipality - applies to unsegregated (mixed) municipal waste, glass waste, paper, plastics and metals, packaging waste multimaterial, biowaste excluding green waste and ashes from domestic hearth. The Contractor is obliged to provide current equipment of the property covered by the subject of the contract with bags in which waste will be collected selectively, in accordance with the provisions of Chapter IX of this OPZ,

- put up by residents in front of the property or in places designated for waste collection, in junk gazebos — applies to all waste received.

3. The Contracting Authority provides for the award of a contract consisting in the repetition of similar services referred to in Article 214 (1) (7) of the Act, up to a maximum of 50% of the value of the basic contract. Details in Chapter VI of SWZ.
