The subject of the contract is the delivery of a city and commune bicycle system for a task under the project 'Construction of a low-emission transport system in the Chełm Functional Area' under Priority Axis 5. Energy efficiency and low-emission economy, Measure 5.4 Low-emission transport of the Regional Operational Program of the Lubelskie Voivodeship for 2014-2020 .

1. The scope of the contract includes the launch of a city and commune bicycle system, comprising a total of 17 bicycle stations, including 14 located in the city of Chełm, 2 in the commune of Chełm and 1 in the commune of Kamień, including:

a) the supply and installation of equipment for maintenance-free bicycle rental, i.e. complete bikes, bicycle stations (terminals and bicycle stands equipped with electronic locks securing the bicycle, including construction works and land development for bicycle stations), a license of a complete IT system supporting the rental bicycles,

b) management and ongoing maintenance of the unmanned bike rental system together with associated services, including maintenance and repairs in the period from the day of starting the rental system to 30.6.2020,

c) servicing the 24-hour Customer Service Office and a dedicated urban and commune bicycle system service other work necessary for the efficient functioning of the city and commune bicycle system.

2. The detailed material scope is determined by:

1) a detailed description of the subject of the contract (Annex 9 to the ToR),

2) location of bicycle stations (Annex 10 to the ToR),

3) project documentation (Annex 11 to the ToR),

4) bill of quantities (Annex 12 to the ToR),

5) technical specification of execution and acceptance of construction works (Annex 13 to the ToR). 3. The detailed scope of the Contractor's obligations covered by the subject of the contract contains a detailed description of the subject of the contract constituting Annex 9 to the ToR.

3. The Contractor shall provide the Employer with a guarantee for a period of 60 months for construction works and 36 months from the date of final acceptance for the remainder of the subject of the contract.

4. The Contractor undertakes to include in all documents that will be prepared in connection with the implementation of the Agreement, information about the participation of the European Union in the co-financing of the Project and designation of documents and place of investment implementation of the European Union logo and the Program logo. The activities are to be carried out in accordance with the provisions contained in the "Guidelines for Beneficiaries in the field of information and promotion of the Regional Operational Program of the Lublin Voivodship for the years 2014-2020". Additional information: In order to assess whether the Contractor relying on the capabilities or situation of other entities on the principles set out in Art. 22a of the Act, will have the necessary resources to the extent necessary to properly perform the public contract and assess whether the relationship between the Contractor and these entities guarantees real access to their resources, the Employer may request documents that specify in particular:

1) the scope of resources available to the Contractor of another entity,

2) the method of using the resources of another entity, by the Contractor, when performing a public contract,

3) the scope and period of participation of another entity in the performance of the public contract,

4) whether the entity on whose abilities the Contractor relies in relation to the conditions of participation in the proceedings regarding education, professional qualifications or experience will perform the services to which the abovementioned capacities relate; The Employer requests from the Contractor, which relies on the abilities or situation of other entities on the principles set out in art. 22a of the Act, presenting in relation to these entities the documents listed in point VI. 7-13 SIWZ; The Employer requests the Contractor to submit the documents listed in point VI.7-13 of the SETC, concerning the Subcontractor to whom he intends to entrust the performance of part of the contract, who is not an entity on whose abilities or situation the Contractor relies on the principles set out in art. 22a of the Act; The method of submitting the EAT is specified in item VI.2-4 SIWZ; The Contractor, within 3 days of posting on the website the information referred to in point XI.11 of the Terms of Reference, provides the Employer with a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the Act.
