DeltaPort GmbH & Co. KG (hereinafter: DeltaPort) operates the Rhine-Lippe port and the city port of Wesel in the area of the Hanseatic city of Wesel and the port of Emmelsum in Voerder urban area (in summary: DeltaPort ports).
For the purpose of the further development of the Rhine-Lippe port, the development plan No. 232 “Rhine-Lippe-Hafen-South” was developed. The corresponding construction plan process is still ongoing. In order to compensate for the intervention through the construction plan procedure in the municipality of the city of Wesel, compensation areas are required for functional compensation. DeltaPort intends to conclude a multi-frame agreement with all suitable (then) sellers who submit an offer as part of this process to ensure the acquisition of the appropriate number of ecopoints.
In the following, bidders and bidding groups are collectively referred to as “bidders”, insofar as the distinction is not important.

In order to compensate for the intervention through the construction plan procedure in the municipality of the city of Wesel, compensation areas are required for functional compensation. To compensate for this, already recognized eco-accounts or the ecopoints kept there should be used. The procedure is assessed according to the procedure “Numerical assessment of biotope types for land use planning in NRW” (LANUV, 2008). If the recognition of the ecopoints by the Lower Nature Conservation Authority has been carried out using a different assessment procedure, the bidder must provide proof of recoding or the ecopoints determined after recoding in the context of the respective individual offers.
The subject of this call for tenders is to cover the requirements for the construction plan process in question here resulting from the public law requirements of approximately 800,000 ecopoints in total according to the current state of knowledge, which are divided as follows:
a) woody plants, individual trees, hems
To compensate for the intervention, extensive woody plants, hedge structures or individual trees (proportion of extensive woody plants up to approx. 120,000 ecopoints, proportion of individual trees approx. 40,000 ecopoints; proportion of hem structures/ruderal areas in connection with the woody plantings approx. 40,000 ecopoints).
b) Grassland/orchards
Approximately 600,000 ecopoints (LANUV, land use planning) must be created or extended to compensate for the intervention. A new installation of grassland would be preferable as a type of measure. A suitable measure for compensation is also the creation of orchards.
c) Semi-open wetland landscape
As an alternative to the biotope structures listed under a) and b), the creation of a diversely structured floodplain landscape with alternation between open land areas and woody structures is suitable to compensate for the intervention in the typical Lower Rhine cultural landscape.
d) unsealing
In order to compensate for the intervention by the targeted large-area sealing of the planned area, it is suitable to carry out desealing measures. Appropriate measures can also be offered.
The ecopoints must have been generated in the Lower Rhine Lowland compensation area (K02). The (then) saleswoman will ensure the long-term maintenance and preservation of the area deposited for the ecopoints and thus the long-term ecological functionality of the compensation measure. It will also carry out regular monitoring and documentation of the measure deposited in ecopoints and report DeltaPort at least once a year.
Due to the need for the site management procedure presented here resulting from the public law requirements, DeltaPORT assumes - based on previous market research - that it will not be possible to acquire the ecopoints from just one seller. DeltaPort therefore intends to conclude a multi-frame agreement with all suitable (then) sellers who submit an offer as part of this process to guarantee the acquisition of the corresponding number of ecopoints. DeltaPort reserves the right to notify the sellers of any additional requirements for the site plan process in question here resulting from public law requirements during the term of the multiple frame agreement. However, a maximum of 1.5 million ecopoints will be called up.
In their tenders to be submitted within this award procedure, bidders must use the forms provided to stipulate the available measures/eco-accounts, the maximum available ecopoints and - divided by measures/eco-accounts - the respective price per ecopoint.
In the course of exercising the multi-frame agreement, the (then) sellers can offer DeltaPort ecopoints under the conditions set out in this award procedure (individual offers). The selection of the specific ecopoints to be purchased is at the discretion of DeltaPort and is carried out after examination by and in coordination with the planners commissioned by DeltaPort and the responsible authorities.
The (then) saleswomen will not be entitled to DeltaPort acquiring ecopoints from them. In particular, DeltaPORT reserves the right to meet the compensation requirements through its own compensatory measures.
DeltaPort will review and coordinate with the authorities within a period of 12 weeks from the receipt of the respective individual offer from the respective (then) seller. During this period, the respective (then) seller will reserve the ecopoints for DeltaPort. If DeltaPort has not accepted the offer of the respective (then) seller after the end of the period, the reservation will end unless it is extended by the seller. In the multiple framework agreement, DeltaPort is granted the right to withdraw from the respective individual call if the development plan No. 232 “Rhine-Lippe-Hafen South” has not become legally binding by 31.12.2023
